中國大陸經濟法體系之反思與完善 中國大陸經濟法體系之反思與完善 陳文祥 中國政法大學 2013 級經濟法專業博士研究生 內容摘要 目前中國大陸經濟法體系是以經濟法的理論為基礎所建構起來的體系，惟隨著貿易自由 化與經濟的國際化發展，經濟法理論雖然也不斷演進，但經濟法體系的建立卻尚不足以 跟上時代的腳步。尤其在經濟法學派林立現況，更為經濟法體系的形成增添了幾分難 度。現階段所有學者對於經濟法的體系究竟是應該具備什麼樣的一個體系似乎尚未達成 共識，且莫衷一是。在經濟發展的多元化的今日，傳統經濟法還來不及建立一套完整的 體系，新的經濟運行模式隨之而來，更加突顯了經濟法的不完備。如何填補現在經濟法 體系的不足，已然成為經濟法的重要課題。本文從新的視角對中國大陸目前經濟法的體 系進行反思，試圖以維護整體經濟利益為其基本價值目標出發，從法律形式上重新建構 一套完整的經濟法法律體系。 關鍵字 ：經濟法 經濟法理論整體經濟利益 經濟法體系 9 龍華科技大學學報第三十六期 ,2015.12 The Reflection and Perfection of the Legal System of Mainland China’s Economic Law ABSTRACT The legal system of Mainland China ’s Economic Law is based on the theory of Economic Law. Nowadays, with the rapid development of international trade and economic liberalization, the theory of Economic Law also continues to evolve, but the established Economic Law system cannot keep up with the pace of the times. Especially in the current situation of Economic Law doctrine with various opinions, Economic Law is more difficult to form a complete and independent system. Today, Economic Law scholars cannot reach a consensus of which Economic Law system should be used. In todays diversified economic development, the traditional Economic Law has been insufficient to meet the current economic situation. How to fill the lack of Economic Law system has become an important subject of Economic Law. This dissertation focuses on the reflection of the System of Mainland China’s Economic Law with a new perspective, trying to maintain the whole economic interest for its fund
