Law allows for intervention before matter becomes animal cruelty. INITIATIVES AND LEGISLATION Goals: Seizure of animals before it results in cruelty Security posting Forfeiture upon conviction Mandated psychological evaluation/treatment Prohibition on future animal possession The situation may require cooperative efforts: Department of Health Department of Buildings Social Services Office of the Aging PROBABLE CAUSE AND SEARCH AND SEIZURE ISSUES Same care should be taken to abide by Constitutional rights in Animal Cruelty cases as any other. Exceptions to the warrant requirement People v. Rogers, 184 Misc2d. 219 (App. Term 2d Dep’t 2000) Warrants A reasonable ground to suspect that a person has committed or is committing a crime or that a place contains specific items connected with a crime. Under the Fourth Amendment, probable cause must be shown before an arrest warrant or search warrant may be issued. In order for the ADA to draft the complaint against the accused, every element of the offense charged and the accused’s commission thereof
