论我国强制医疗制度的完善 摘要 放眼全球，很多国家都建立了一套比较完备的强制医疗制度，但是我国的进程却很缓慢。近几年来，精神病患者犯罪案件不断增多，这也引起了对精神病患者强制医疗措施的探讨。 本文主要从以下三个方面我国的强制医疗制度完善作出了论述： 第一部分：对我国的强制医疗制度进行整体的概述。具体包括强制医疗制度的概念和特征，强制医疗制度的具体价值。 第二部分：对于我国现象法律对强制医疗制度作出的规定进行分析，同时阐述了我国的强制医疗制度存在哪些问题。 第三部分：针对第二部分提出的一些问题，从对象方面、程序的设计方面对我国强制医疗制度的完善提出自己的意见。 强制医疗程序是对精神病人自由的一种限制，因此在具体实践中，不免会造成对其合法权益的侵害。因此，强制医疗措施的实施有很大的难度。本文只是抛砖引玉，希望有更多的学者进行相关问题的研究，最终实现精神病人权益保护与社会秩序稳定的完美统一。 关键词：刑事强制医疗 保障人权 正当程序 Abstract Looking at the world,?many?countries have established?a relatively complete?system of compulsory medical treatment?in our country,?but the process?is very slow.?In recent years,?criminal cases of psychiatric patients?continue to increase,?which also caused a discussion on?medical?compulsory measures of?psychiatric patients.
