【内容摘要】 劳动合同关系到合同双方当事人的切身利益,也是处理劳动争议的主要依据之一,而《劳动法》关于劳动合同的条款规定较原则、抽象,使得有关劳动合同争议案件的处理比较困难。同时,由于我国在劳动合同立法方面不完善,关于劳动合同的法律制度没有形成体系,大部分有关劳动合同制度的规定在《劳动法》中没有提及,由此使得广大的劳动者与用人单位在签订劳动合同时不能很好地维护自己的合法权益。因此,不管是用人单位还是劳动者都应该掌握一定的劳动合同知识。本文主要就劳动合同的书面订立形式、事实劳动关系、拒绝或者拖延订立劳动合同的情形、劳动合同的内容要符合法律要求、劳动合同订立不符合程序要求等问题进行探讨,要解决这些问题只有通过完善立法和实施其他一些措施,这样才能完善我国的劳动合同制度,切实保护劳动者的合法权益。

Abstract:Labor contract refers to the benefits of employee and employer and it will be an evidence to deal with the conflict between them. However, the item of labor contract in the Labor Law of China is abstract, and just this makes it difficult to cope with the conflict cases of labor contract. At the same time, because China has not draft enough laws to regulate the process of concluding a labor contract. In addition, the laws are not systematic, and many items are not concluded in the Labor Law. All of it make the employees could not defend their benefits practically when conclude a labor contract with employers. Therefore, no matter which employees or employers should master some knowledge of how to conclude a labor contract. My thesis is focus on several questions, such as labor contract should work out by the written form, factual labor-relationship, the situation of reject or delay working out the labor contract, the labor contract content must conform to the legal requirement, the labor contract works out does not conform to procedure and requirement, etc. Only consummates the legislation and implements some measures can we resolve these problems, prefects our country labor contract system, protects employee’s legitimate rights and interests practically.
