摘要“两型社会”作为新的国家发展理念，不仅为整个社会指明了新的发展方向，而 且提出了一系列新的要求。我国的立法机关作为履行立法、监督等职权的主体对 建设“两型社会”无疑具有重要的地位和作用。但是，立法机关在履行职权过程中既 充当了“运动员”又扮演着“裁判员”，存在着大量不利于资源节约、环境友好的行为 并产生了相对应的不利影响或危害后果，却几乎不受任何监管。在“两型社会”建设 语境下对立法机关环保监管模式研究，就是要使立法机关的履职行为，尤其是行 为可能产生的结果符合建设“两型社会”的目标要求。关键词：两型社会，立法机关，环保监管，模式，体制机制ABSTRACTTwo-oriented society as the countrys new development concept, not only pointed out the new direction of development for the whole society, but also proposed a series of new requirements. In the construction of the two-oriented society, Chinas legislature has an important position and role as the body to fulfill authority of legislative and supervision. However, the legislature both act as athletes and judge in the course of its terms of reference. There is a large number of unfavorable to the resources-saving and environment-friendly behavior and produce adverse effects of the corresponding or harmful consequences, but almost not subject to any regulation.
