劳动合同变更问题分析-analysis of labor contract change
摘 要劳动合同变更在现实生活中是一种常见的现象,是用人单位与劳动者在劳 合同签订后尚未履行完毕的过程中,针对各种主客观情况的变化而采取的应对 措施,劳动合同的依法及时变更,对维护劳动合同双方当事人的权益具有重要的 意义。目前劳动合变更在实践中出现的问题已经反映了现行法律制度的缺陷。劳动 合同变更制度为与劳动者权益密切相关的一项法律制度,一直没有引起人们的广 泛关注,理界和实务界也很少对此展开深入的探讨和研究。如何正确认识劳动合 同变更的特殊性,如何完善劳动合同变更制度是值得深入研究的课题。劳动合同最大的特点在于其是继续性合同,一旦出现阻碍合同继续进行的事 由时,劳动关系的稳定性要求对劳动合同进行变更,从而使劳动合同得以继续履 行。而劳动合同变更遵循合同自由原则、对劳动者倾斜保护的原则、尊重用人单 位用人自主权原则。从不同的角度,劳动合同变更主要存在三种类型:法定变更 与约定变更、临时变更与固定变更、利益变更与不利益变更。目前,学界鲜有论及规章制度和集体合同对劳动合同变更制度的影响,针对 于此,本文从劳动合同的相关制度与劳动合同变更的关系入手,主要探讨规章制 度与集体合同对劳动合同变更的影响,分析当前相关制度在定性上不当,最后, 指出相关制度对劳动合同变更的具体影响,避免劳动合同变更中出现不合理现 象。本文从类型化的视角,对劳动合同变更进行类型化研究。将合同变更制度分 为四种基本类型即法定临时变更、约定临时变更、法定固定变更、约定固定变更。 并对这四种类型进行了更深入的类型研究,分析各类型存在的主要问题,并提出 相应的对策。我国目前劳动立法存在对约定变更条件规定比较宽松、合同变更效力的评判 标准不清、劳动合同变更体系不全等问题,针对我国目前劳动合同变更制度的现 状,提出了从从严把握约定变更的条件到完善劳动合同变更效力的评判标准再到 完善我国劳动合同变更的制度体系三个方面,逐步完善我国劳动合同变更制度的建议。关键词:劳动合同法定变更临时变更不利益变更ABSTRACTThe modification of labor contract is a very common phenomenon in daily life, which is an important measure taken by employing units and labors when the subjective and objective conditions have greatly changed during the fulfillment of labor contract. Through modification of labor contract, the parties involved can adjust their rights and obligations in accordance with various changes. So, it is very important for protecting legitimate rights and interests of parties involved by modification of labor contract promptly and legally.Issues of modification of labor contract in practice show all of defects in current legal system of modification of labor contract. As an important law system that relates to the legitimates rights and interests of laborers closely, modification of labor contract has not been concerned adequately for long time, and has seldom been deeply probed in both theory and practice.
