旅游合同中营业人瑕疵担保责任研究中文摘要随着我国经济实力的不断增强，人民的生活水平日益提高，旅游现下已经成为首选的 休闲娱乐方式，实际生活中旅游者因处在弱势地位而遭受损害的情况时有发生。但我国旅 游合同的法律法规相对滞后，没有统一的规定，有关旅游合同中营业人法律责任的规定更 是缺乏可操作性，这既不利于化解旅游纠纷，也有碍旅游业的健康发展。所以，为了解决 纷繁复杂的旅游纠纷，全面保障旅游者的合法权益，体现法律的公平公正，确立旅游合同 中的营业人瑕疵担保责任制度势在必行。这既是由于旅游合同自身的特殊性决定的，也是 法律对旅游者利益更大限度的维护。旅游合同中的营业人瑕疵担保责任的构建对我国旅游 业繁荣、稳定的发展必将有着非凡的意义和深远的影响。本文主要从四个方面对旅游合同 中营业人瑕疵担保责任制度的构建进行理论上的初探。第一章从旅游合同的概念、法律特征及营业人的范围界定等基本问题切入，明确界定 营业人瑕疵担保责任的内涵和外延，对旅游营业人瑕疵担保责任进行了概述，并将之与相 关责任进行比较；第二章介绍了德国、日本及我国台湾地区有关营业人瑕疵担保责任的规定，并将德国、 日本和台湾地区的营业人瑕疵担保责任进行了对比说明，为我国提供了宝贵的立法经验；第三章介绍了当前旅游纠纷的现状和我国的现行法律规定及存在的不足，提出了确定 营业人瑕疵担保责任的必要性并对此加以详尽剖析；第四章对营业人瑕疵担保责任的构建进行了全面论述，提出旅游合同有名化及其必要 性，着重介绍了营业人瑕疵担保责任的表现形式，并从旅游营业人造成的旅游瑕疵和第三 人造成的旅游瑕疵责任两方面分别阐述、营业人瑕疵担保责任的承担方式以及营业人责任 的限制和免除，最后通过对营业人瑕疵担保责任的粗浅分析，就体系编排和条款规定提出 笔者设计，并对制度编排做出了理论分析。关键词：旅游营业人 旅游者 旅游合同 瑕疵担保责任Defect warranty responsibility of tourismbusinessAbstractAlong with the economic level enhancement, tourism has become the first choice of people entertainment . Because the tourists are in weak position, It often happens that tourists interests damaged. But our country tourism contract laws are relative lag and there is not have a unified regulation . The business of the provisions of the legal responsibility is lack of operability . This will not be conducive to resolve tourism disputes, and is a hindrance to the healthy development of the tourism industry . Therefore, it is necessary to establish the tourism business people warranty system and solve a lot of tourism disputes . That’s could to protect the lawful rights and interests of tourists maximum limitly.This paper from four aspects to warranty on the construction of theoretical study .The first chapter cut from the concept of the travel contract, legal characteristics and the scope of business definition to reviewe the business people warranty ,Compared with the related responsibility .The second chapter presents the German, Japan and Taiwan business people on the provisions of the warranty and comparative analysis these three rules
