AlthoughitseemsthattheCivilFraudulentConducthasnorelevancetothePunitiveDamages,infactthereexistsmuchrelevancebetweenthetwotheses.Thushowtoestablishtheirrelationshipreasonablyisofgreatimportance.CivilFraudulentConductsincludethefraudulentconductinjuristicactandthefraudulentconductintortlaw.Theirdifferenceslieintheconstituentelementsandthelegalconsequences.Forthefraudulentconductinjuristicact,itsconstitutionjustrequiresthedefendant’sfraudulentconductwhichleadstheplaintifffallsintomistakesandmakestheincorrectdeclarationofwill;anditslegalconsequenceistheinvalidityortherevocabilityofthisjuristicact.Butthefraudulentconductintortlawisonekindoftortswiththeoccurrenceofdamageandtheconsequenceoftortliability.ThePunitiveDamagesbelongtothecivilcompensationliability,forthepurposestopunishtheseriousillegalact,topreventthereoccurrenceofthisact,andtomakethewrongdoertobeartheextradamagesexceptforactualdamages.Becausethefraudulentconductsbothinjuristicactandintortlawhastheanti-moralityandthemoderncivillawdevelopssocialstandardandhumanisticsolicitude,theycanapplytopunitivedamagesprobablywhencertainconditionsaresatisfied.Throughthecomparativestudyonthelawsinthecommonlawcountriesandinthecontinentallawcountries,itisdiscoveredthatwhenthecivilfraudulentconductappliestothepunitivedamages,somelogicshallbefollowed:theconstitutionoffraudulentconductinjuristicactdoesnotrequirethedamagefactandthedirectconsequenceistheinvalidityandrevocabilityofjuristicactratherthanthecompensationliability,whichcannotdirectlyapplytopunitivedamages.Therefore,ifthefraudulentconductinjuristicactappliestopunitivedamages,thepreconditioniscombiningtheobjectiveelement,thedamagefacttofurtherassessasthefraudulentconductintortlaw.Inotherwords,thefoundationofrightofclaimisfinallybasedontheregulationsoftortlawwhenthecivilfraudulentconductappliestopunitivedamages.However,becausethepunitivedamagesitselfhasgreatsideeffect,itneedstobenoticedthateventhecivilfraudulentconductmeetsallconstituentelementsofthefraudulentconductintortla
