AbstractThelandisthematerialbasisofhumansurvivalanddevelopment,andthelaborofsocialproduction,thebasicmeansofagriculturalproduction,isalsoafootholdinthiscountry,thedevelopmentofthenationaleconomycannotbeseparatedfromland.TheLandLawisalegalsystemthatregulatedtolanddevelopment,utilization,regulation,protectionandmanagementactivitiesofthevarioussocialrelations,itwasconducivedtosafeguardtheinterestsoflandeconomy,tomaintainthesocialandeconomicorderandstabilizeinthecountryspoliticallandscape.TheFederalRepublicofNigeriawasacolonyofBritish.Affectedbythishistoricalfactor,theNigeriangovernmentdecreedTheLandUseActin1978,theActinfluencedbytheBritishlawtoacertainextent.TheActaimedtothenationalizationoflandinNigeria;Asaresult,therewasthesystemofstatelandownershipinNigeria.AndtheoriginallandsystemispreservedduetoNigeriansrespectedforcustomarylawinNigeria.AccordingtotheLandUseActandthecustomarylaw,thispapersimplyintroducedthesystemoflandownership,thesystemoflandoccupancyandthesystemoflandtransferenceinthelandsystemofNigeria,andanalyzedandcomparedwiththelandsystemofChina.Thesystemoflandownershipcomposedofstatelandownership;thecommunallandownership,thefamilylandownershipandindividuallandownershipinNigeria.ThelandoccupiersenjoytherightsofoccupancyinthefourkindsoflandinNigeria.Underthecertainconditions,thelandoccupierscantransfertheirrightsofoccupancy.Withthedevelopmentofeconomy,thegovernmentfoundthattheexistinglandlawcouldnotsolvetheincreasinglyprominentlandproblem,sotherehasstartedanewroundoflandreforminNigeria.Therefore,manyscholarsputforwardsuggestionsforthelandreform,andthegovernmentprepareforthereforminNigeria.Thedistinctiveeconomicandsocialconditions,determinesthecharacteristicsofthelandsysteminNigeria.Attheendofthispaper,inordertoprojectthecharacteristicsoftheNigerianlandsystemandgetsomeinspirationfromtherelatedlandsystemthroughthecontrasttheNigerianlandsystemwiththeChineseone.Keywords:Nigeria;thelandsystem;customarylaw;TheLandUseActII目录引言........................................
