农村生产生活垃圾问题地方立法实证研究中文摘要在物质生活日益丰富的现代社会，环境保护问题被提上了日程。由来已久的“重城市、轻农村”的观念，使得农村经济落后，环境问题日益严重也是可想而知的。环境方面的法律在逐渐完善。在文中，作者将以非常突出的农村生产生活垃圾为着手点，提出一些地方立法上的建议，使得农村的环境保护尽快的有法可依。本文通过实地调查，从而引出农村生产生活垃圾地方立法的必要性，主要包括：第一部分是以作者所在家乡为调查对象，进行实地的考察。对于农村生产生活垃圾所产生的现状及其危害进行了细致的调查，并加以分类总结。为当地进行农村生产生活垃圾的地方立法提供依据，并反映出急需立法的迫切性。第二部分是对于造成农村生产生活垃圾污染的原因进行分析。主要通过两方面：首先，就是本质原因进行概述，其次，就是对于立法、执法的法律原因进行细致的分析。并指出在农村垃圾处理问题地方立法上一直处于缺位状态，并引用了已有的地方立法规定作为借鉴。同时，在农村生产生活垃圾处理上政府部门也做过努力，但多是政策性规定，缺乏执行的力度，彻底性的整治还是需要法律的权威性作为后盾。第三部分就是作者针对以上的调查研究，进行分析整合，提出有关农村生产生活垃圾处理的立法建议。首先，对于农村生产生活垃圾的处理提出两条急需确立的制度；随后，对于政府与公众的义务与权利进行了细致的规定，在义务没有履行的前提下规定了应予承担的法律责任。最后，对于因农村生产生活垃圾造成污染的情况下，村民或是受污染者针对自己的权利受损害的救济途径进行罗列。这些规定，都应在地方立法中进行细致的规定。使农村生产生活垃圾处理、整治能够依法进行实施，并使得立法剔除原则性，具有可实施性。关键词：生产生活垃圾环境污染地方立法ResearchonRuralProductionandLivingWasteofLocalLegislationAbstractInthematterofthemodernlifebecomingincreasinglyrichandcolorful,environmentalprotectionproblemsareputontheagenda.Theage-oldheavycity,lightcountrysideidea,makestheruraleconomybackward,seriousenvironmentproblemisincreasinglypalpable.Environmentalprotectionlawisperfectedgradually,Inthispaper,theruralproductionandlivinggarbagewillbethehighlight,andsomesuggestionsarealsoputforwardonthelocallegislation,makingthecountrysideenvironmentprotectionhavebaseassoonaspossible.Basedonthefieldinvestigation,thenecessityoftheruralliferubbishintheproductionoflocallegislationisdrawn,mainlyincluding:Thefirstpartisinvestigationofthewriter’shometown,meticulousinvestigationismadeandclassifiedforruralproductionlivinggarbageproducedonthecurrentsituation.Thisprovidesthebasisforthelocallegislationofruralproductionandliferubbish,andreflectstheurgentneedoflegislation.Thesecondpartisanalysisofthecausesfortheproductionandlivingwastepollution.Mainlyfromtwoaspects:firstofall,theessentialreasonsaresummarized;second,legalreasonsofthelegislationandenforcementaredetailedanalyzed.Meanwhile,thelocallegislationhasbeenintheabsenceofstate,andtheexistinglocallegislationhasbeencitedasreference.Althoughgovernmentdepartmentshavemadeeff
