纵观世界各国宪法典，将地方立法作为宪法规制的基本对象，已成为当下宪法典发展的主流趋势。欧州国家具有浓厚的地方自治传统与地方自治理念，在地方立法方面积 累了较为完备的经验。然而在我国的宪法文本中对地方立法权的规制基本处于缺位状态 或者点到即止，地方越权立法、地方立法不作为、地方立法形式主义、地方保护主义等 问题层出不穷。在我国地方立法实践中的许多难点问题长期未能得到有效解决的情况 下，本文从比较法的视角以及宪政的高度探究欧洲国家地方立法权配置模式，明晰欧洲 国家宪法中的地方立法制度以及地方立法权限的配置原则和方法，不失为解决我国地方 立法实践问题的另一种有效途径。本文研究的主要任务主要是从比较法的视角，对欧洲国家地方立法权配置的宪法模 式的基本理论、具体类型、成因以及不同模式对欧洲国家发展的影响进行分析研究，汲 取欧洲国家关于地方立法制度的治理经验，从而重新审视中国地方立法的理论和实践问 题，为当前我国地方立法权的合理配置理出思路，以构建科学和谐的地方立法秩序，促 进地方立法的宪法化进程。文章的第一部分主要是对欧洲国家地方立法权的配置的基本理论进行论述。这一部 分主要分为两个小部分，分别介绍欧洲国家地方立法权的基础概念以及欧洲国家地方立 法权的理论形态，为整篇文章的行文奠定理论基础。第二部分以欧洲 44 个国家的宪法 文本为研究对象，具体分析不同划分标准下欧洲国家地方立法权配置的宪法模式类型。 文章第三部分探讨欧洲地方立法权宪法配置模式的成因，深入地了解欧洲地方立法权配 置的宪法模式形成的自然地理环境、政治、经济、文化以及民族渊源；其次，采用 SPSS 统计软件，设计民主指数、法治指数、人类发展指数三个变量来研究分析不同的地方立 法权配置的宪法模式对欧洲国家发展的影响，进而对不同模式的利弊进行阐释。第四部 分对欧洲各国地方立法权配置的宪法模式所呈现的一些共同特点和总的发展趋势进行 判断和归纳，探索其地方立法权配置的一些先进的宪法理念、宪法规制原则和方法，为 我国地方立法权配置的宪法化进程提供可资借鉴的经验与启示。关键词：欧洲国家；地方立法权；宪法配置模式；研究Throughout the constitutional code of all countries in the world , the local legislation power as the basic object of constitution regulation, has become a main trend in the development of the present constitutional code. Most European countries have a strong local autonomy tradition and local autonomy concept, and these countries has accumulated complete experience in the aspect of local self-government and local legislation. However, in the text of the constitution of our country to regulate the local legislative power of the basic in the absence of a state or point to namely stop. As a result, in the case of many of the local legislation practice in our countrys long-term failed to effectively solve the difficult problem, this article from the perspective of comparative law and the height of the constitutional government to seek European countries constitutional configuration modes of local legislation and to clear the local legislation of the countrys
