网络诽谤刑事问题研究——以记者刘虎案为例中文摘要网络诽谤是指在网络信息化高度发达的当今社会，通过微信、微博、博客等新兴的网络媒介将含有诽谤性的虚假言论予以扩张、传播的行为。由于网络信息传播存在着速度快、波及范围较广、信息量纷繁复杂等诸多特点，致使网络诽谤比传统诽谤的影响更大、危害程度更深。在原有法律法规对于频繁出现的网络诽谤行为无法进行规范的情况下，2013年两高联合发布关于网络诽谤的司法解释，对于网络诽谤行为的入罪条件作了进一步细化，尤其是对于“情节严重”等构成要件的认定作了具体的量化。但是，由于司法实践中对法律条文理解的偏差，导致很多司法运用上的不准确，“转发五百次”入刑引发了人们的广泛讨论与诟病。本文以记者刘虎网络诽谤案入手，以我国现行的法律法规为依据，运用个案研究法及类比分析法，通过对案例中存在的争议焦点进行剖析，引入网络诽谤中的一些具体实务问题。本文共分为四个部分：第一部分介绍基本案情，归纳争议焦点，通过记者刘虎案引入网络诽谤中存在的相关法律争议问题。第二部分探究网络举报失实是否构成网络诽谤这一问题，从主观上是否存在诽谤故意，客观上是否造成损害他人名誉的后果两个方面进行分析，认为网络举报是公民言论自由的表现，纵使部分失实也不属于网络诽谤；第三部分从立案管辖角度来看，本案未达到“严重危害社会秩序和国家利益”的程度，不符合诽谤罪自诉转公诉的条件，从地域管辖角度来看，北京警方远赴重庆抓捕不具备合法性。第四部分在不违背现行法律规定的情况下探究网络诽谤中举证责任的划分问题，认为捏造内容真实性的证明责任应由诽谤者承担，散布行为严重性的证明责任应由被诽谤者承担，同时建议在个人取证困难时可以请求公权力救济，从而解决实际中由于取证困难而导致公民权益无法保障的困境。本文试图通过分析这些与网络诽谤有关的争议问题，来探究网络诽谤罪与非罪、自诉转公诉、管辖适用及证明责任分配等问题，对司法实务中相关问题的处理提出一些自己的观点。关键词：网络诽谤诽谤言论自由ResearchonthecriminalproblemsofinternetdefamationAbstractInternetdefamationisabehaviorofspreadingfalsedefamatoryinformationthroughthemicromessage,micro-blog,blogandotheremergingnetworkmediaintoday’shighlyinformationalsociety.Becausethenetworkslanderspreadfast,wide,complicatedandothercharacteristic.byusingtheinternetdefamation,thesocialinfluenceisbiggerandmoreharmfulthanusingthetraditionalway.Therefore,theinternetdefamationhasgainedwidelyattention.Intheinternetenvironment,howtocontrolthebehaviorofdefamationhasbecomeanurgentproblem.In2013,TheSupremePeople’sCourtandTheSupremepeople’sprocuratoratejointlyissuedajudicialinterpretationontheinternetdefamation,furtherrefinedtheconditionsofinternetlibelandspecificquantifiedtheelementsofidentificationsuchas“serious”.However,duetothedeviationoftheunderstandingofthelawinthejudicialpractice,alotofthejudicialapplicationwasinaccurate,andhowtofurtherclarifytheintensionandextensionoftheidentificationstandardofinternetdefamationisthemainpurposeofthisarticletodiscuss.Combiningthelatestjudicialinterpretationontheinternetdefamation,thearticlestartwiththereporterLiuHu’slibelcase,throughtheanalysisofthefocalpointandthecont
