ABSTRACTIn1975,EleanorRosch,aprofessorofpsychologyattheUniversityofCalifornia,Berkeley,proposedthePrototypeTheory(PT)inherpsychologicalexperiments.Henceforth,thistheoryiswidelyappliedincognitivepsychologyandtranslationpractice.UnderPT,translationisconsideredasaspatiallyandtemporallyspecifiedactivitytoseekthebestexemplarsofboththesourcelanguage(SL)andthetargetlanguage(TL).Andthetranslatingprocesscanbespecifiedintothreesteps,thefirstistorecognizetheprototypeofSL,thentosearchforthecorrespondingTLreader?sprototype,andfinallytoreconstructSLprototypewithTLprototype.Inviewofthis,PTcastsnewlightonlegaltranslation.ThispaperadoptsPTasthetheoreticalframework,andtakesthetranslationof“Fa”asacasestudyinordertoinvestigateintotheprototypeof“Fa”andtherepresentationofitsprototypeeffectintranslationinthefollowingaspects.First,thispaperconstructstheprototypeof“Fa”fromtheperspectiveofetymology,semanticmeaningandpragmaticmeaningandfindsthattheconstrualof“Fa”canbecategorizedintosuperordinatecategory,basiccategoryandsubordinatecategory.Second,thispapertentativelyproposesaprototypeapproachtorender“Fa”inordertohighlightitsprototypeeffectthroughthefollowingsteps.a)Toclassify“Fa”intodifferentcategoriesbasedonitsattributes;b)Toconstructthecorrespondingexpressionof“Fa”inEnglishinordertosearchforTLreader?sprototype;andc)TounderstandandfindcorrespondentTLprototypetoreconstructSL.Finally,thispaper,concerningadeviationexistingbetweenactualprototypeandidealprototypeintranslation,appliessomestrategies,i.e.cognitivedomaintransfer,categoryconsistency,culturalcompensationanddescriptiveparaphrasetoreducesuchdeviations.Inbrief,PT,asacognitivepsychologyandcognitivelinguisticsstudy,providesaneffectiveandpracticalwaytolegaltranslationinthatithelpstoconstructandintegrateprototypicalinformationintheprocessoftranslation.Thispaperaimsatprovidinganewwaytounderstandthelegaltextandliteraturefromacognitivepointofview,hopingthatitwillmakesomecontributionstothefuturestudyoflegaltranslation.Keywords:PrototypeTheory;Fa;c
