【关键词】抽象行政行为 行政诉讼 司法审查 【英文关键词】abstract administrative acts administrative litigation judicial review 抽象行政行为论文：论我国抽象行政行为的司法审查 【中文摘要】抽象行政行为的司法审查伴随着我国行政法制建设的推进的状态,它俨然已经成为我国行政研究的一个核心课题。在我国经济、政治领域继续深化改革变化的背景下,公民的法律意识普及急需增强之时,政府依法行政的水平要求日益提高,这不仅仅要求要对具体行政行为进行司法审查,同时也更应该对行政机关作出的关于指示其具体行政行为的抽象行政行为进行审查。将抽象行政行为纳入司法审查的范围在世界部分地区和国家都得到了普遍的认同,但是在我国却由于受到“抽象行政行为具有不可诉性”观念的影响,至今没有将抽象行政行为纳入司法审查范围。在这个背景下由抽象行政行为违法侵犯公民、法人的合法权益事件屡出不穷,对于抽象行政行为的侵权所造成的损害,法律却没有赋予行政相对人以自救的途径,这就违反了社会主义法治的基本精神、原则。虽然我国建立了抽象行政行为的监督机制,但是因为它们本身就存在缺陷,这种司法监督的缺位导致了我国对抽象行政行为监督机制存在有严重的不足与缺陷。为了满足我国民主建设和市场经济发展的需要,我们有必要对抽象行政行为进行司法审查,并在法律中给予明确的规定,以更好的保护行政相对人的合法权益,构建一个和谐稳定的法治社会。 【英文摘要】Abstract administrative acts of judicial review along with the advance of the Construction of Administrative Law in China, it has become an important topic in China抯 administrative research.
