I I 摘 要 随着我国经济社会的迅速发展，各种利益格局的不断调整，社会矛盾纠纷呈现出成因复杂化、 内容多样化的特点，使法院的受理案件总量和新类型案件与日俱增，加剧了法院受理案件数量大 幅上升与司法审判资源有限之间的矛盾，形成了新一轮的诉讼危机。同时，在国际上享有“东方 经验”的人民调解制度具有点多、面广、人员足、亲和力强的特点，在化解矛盾，促进和解方面 发挥着积极作用，并在发展中日益完善。分析研究和运用诉讼调解和人民调解之间的功能差异及 其互补关系来解决当前法院面临的压力，一方面能促进社会矛盾纠纷的有效化解，有利于维护社 会和谐稳定，另一方面可以使案件合理分流，以便法院能够集中精力处理疑难复杂案件，节约司 法资源，保证裁判质量，提高司法权威。目前，ADR 受到世界各国的普遍重视，各国法院积极出 台各项制度鼓励纠纷当事人选择相对灵活和自治性强的非诉讼途径来解决矛盾纠纷。为实现多元 化纠纷解决方式的有效互动，化解我国诉讼危机，本文借鉴国外的研究成果，结合我国实际情况， 从理论和实践两方面对诉讼调解与人民调解对接机制进行分析研究，通过对我国诉讼调解与人民 调解对接的正当性基础和价值功能的探讨，实践中诉讼调解与人民调解对接模式及其存在问题的 分析，提出对我国诉讼调解与人民调解对接的建议，以期对司法实践起到一定的参考作用。 本文除绪论和结束语外共分为四章。“诉讼调解与人民调解对接概述”部分，提出了研究对 象的概念界定，并对我国诉讼调解与人民调解对接机制理论纷争做一简要归纳和评述。“诉讼调 解与人民调解对接机制的正当性基础及价值分析”部分，首先从我国现行法律法规入手，从政策 导向、构建司法制度需要等四个方面提出了诉讼调解与人民调解对接的正当性基础。然后，从自 由、效益、正义、秩序等法律价值的角度入手，分析诉讼调解与人民调解对接机制存在的价值。 “诉讼调解与人民调解对接机制在实践中的运用”部分，以实践中诉讼调解与人民调解对接的五 种模式为研究对象，分析两种制度在对接中的现实效果。“构建诉讼调解与人民调解对接机制” 部分，从服务理念、程序、实体三方面入手对两种制度的对接进行制度设计，从而使文章更具有 现实指导意义。 关键词：诉讼调解，人民调解，对接 II II Abstract With the rapid development of our economy and society and disputes presents complex，diverse nature of content. in china，the pattern of the various interests and social causes of conflicts to constantly adjust.
