II II Abstract Research on the standards of the relatively large cities exercising the local legislative power Research on the standards of the relatively large cities exercising the local legislative power Abstract Since the “Organic Law of the Local Peoples Congresses and Local Peoples Governments of the Peoples Republic of China” formulating the local legislative power of the relatively large cities in the 1982, the additional standards of the relatively large cities have determined which city can obtain the local legislative power. However, because of its own shortcomings, the additional standards of the relatively large cities have always been in the controversy. The latest “Legislation Law of the Peoples Republic of China” formulates the clear standards for the cities divided into districts that can exercise the local legislative power, which is attracting the academia to resume the research on it. Today, after the comprehensive decentralization of the local legislative power, the relatively large cities have been expanded to the cities divided into districts, and the power to add these cities who can exercise the local legislative power was decentralized to the provincial Peoples Congress. How to improve the standards for the exercise of the local legislative power becomes the problem for the provincial Peoples Congress. This paper is to introduce the relatively large cities’s history, clarify the course of its development, and reflect on the system that the State Council sets up it. Then, the paper is planning to base on the amendment of “Legislation Law of the Peoples Republic of China”, to analyze the background before the amendment of “Legislation Law of the Peoples Republic of China”, describe the disputes about the comprehensive decentralization, and point out the outlet for the relatively large cities exercising the local legislative power.
