I I 摘 要 调查数据表明，当前，我国老龄化越来越严重，可以说，我国正在逐步步入老 龄化社会。我国的单身老年人指的是丧失配偶、尚未结婚和已经离婚的老年人，他 们的数量占全部老年人的人口比例正在逐步的增加，老年人再婚出现的一系列问题 也日益显现。近几年来，选择不领结婚证只是一起同居的“再婚”模式的老年人越 来越多，此文将其称为“银发同居”现象。老年人选择“银发同居”这一方式有一 定的好处也有一定的弊端。我们不能因为同居关系的非法化就不保护这些老年人的 合法权益，正确看待选择不领结婚证只同居的方式并且对这部分老年人的权益进行 保护，是我们法律工作者义不容辞的责任。 本文第一章描述了目前我国 “银发同居”的现状，并从子女干涉、老年人自身 等方面分析了老年人选择这种方式的原因，第二章对“银发同居”的益处和弊端分 别进行了深入的分析，第三章分析了我国的立法现状，以及我国对同居关系的四种 态度的演进，第四章分析了国外的立法制度并分析了对我国立法的借鉴，第五章提 出增设老年人“准婚姻制度”的立法建议。 关键词：老龄化；再婚；立法漏洞；国外立法；老年人“准婚姻制度” II II Abstract The survey data shows that at the current, aging in China is more and more obvious. It can be said that China is gradually aging society. The number of Chinas single elderly in total elderly population proportion the remarriage series is gradually increased. Chinas single elderly is the loss of a spouse, has not been married and divorced. The questions also apparent. In recent years, the remarried elderly who has not the marriage license is growing rapidly. This article referred to as the silver-haired cohabitation. Seniors can choose the approach of the silver-haired cohabitation, and it has some benefits and some disadvantages. We have to protect the legitimate rights and interests of the elderly because of the illegal cohabitation relationship .Have a correct view of the choice of not receiving a marriage certificate and only cohabitation and protect the rights of this part of the elderly, is the bounden duty of our legal workers. The first chapter describes the status of Chinas silver-haired cohabitation, and the reasons of choosing this way because of the interference from the children and the elderly themselves. The second chapter describes the benefits and drawbacks of this way. The third chapter analyzes the status of Chinas legislature, as well as the evolution of four attitudes in China.
