Abstract This is a translation report for Chapter 3 of The Historical Foundations of Law Relating to Trade-Marks. This book is a description of the development process and formation of law relating to trade-marks from the perspective of history. In the translation practice, the author finds that the legal terminology has contributed to the difficulties of doing translation of the legal scholarly writings because of the unique qualities of the terminology. The author of this translation report has applied the traditionally used literal translation and liberal translation in conjunction with the particular considerations of the historical influence of the legal terminology to do the legal translation, wishing this practice may be beneficial to the probe into the future study of translation theories and practices.
