贵州大学硕士研究生学位论文 贵州大学硕士研究生学位论文 II II 裁方式的重要性在各国并不一样。随后,重点探讨了我国现行立法的缺陷:法律 定位不明确,立法滞后,法律规制的适用范围窄,法律规范不合理不明确,法律 责任制度欠缺等。 第三部分是有关我国比较广告法律制度的完善的问题。本文针对上文中的论 述,给出了比较广告法律规制的一些建议。对正当合法的比较广告构成要件进行 了归纳:对象具有可比性,内容不得有误导性,比较方法得当,语言使用准确规 范。对于比较广告立法缺陷提出了如下建议:将比较广告纳入《广告法》的调整 范围,建立严格的比较广告法律标准,比较广告举证责任的承担,以明确的法律 规定比较广告的全面监管。 关键词:比较广告 合法性 误导 诋毁 立法建议 PAGE PAGE IV Legal Regulation on Comparative Advertising Summary As one kind of operating model of commercial advertising 。 Comparative ad appears universally , but it always leads disputes , Due to adopting of the method of comparison,the character decides the coexistent of the advantages and disadvantages therefore,it is particular necessary to make a research on the legal issues arising from comparative ad for preparing future legislation,it is also the issues the author will discuss。 This dissertation is divided into four parts. The first part focus on the basic problems including the definition , the different types and legal features of comparative information. The second Part analyses the legitimacy of Comparative advertise, Comparative Advertising has both economic value and social value, Based on jurisprudence, Comparative Advertising has closely connection among freedom of speech, freedom of economic , the Principle Of economic law. Comparative Advertising has rationality and validity. Adjudging standard of comparative Advertising is also expounded in this part. Comparative Advertising has negative influence on economy when it is against the legal rules, it must follow the basic legal principle Include honesty, fairness and true, not mislead and not fame. The third part focuses on illegal comparative Advertising including how to Cognizance illegal comparative advertising, especially misleading comparative advertising and defame comparative advertising, because these are the most popular way of comparative advertising.
