Abstract With the development of China’s economy, urban planning has become an indispensable means of government management. Although urban planning has enjoyed a rapid development along with the acceleration of urbanization, many problems are seen in this field. The most prominent one is the lagging of legal provisions, among which the lack of procedural requirements is the most serious problem. Thus, it results in the big mismatch between theoretical research and actual operation, which leads to a series of problems such as the economic development, the social stability and the legitimate rights and interests of citizens are jeopardized. The forward-looking nature of urban planning has its own advantages, but n a country where legal provisions are insufficient, it is bound to bring a series of disadvantages such as making the urban planning too broad, unstable or infeasible, etc, which are undoubtedly in contrary to the goal of building a country under the rule of law in China and the requirements of implementing administrative management according to law. Therefore, in order to make the government implement urban planning in a legitimate and reasonable manner, the most important issue is to set procedural provisions for it. This paper is divided into five parts: In the first part, the basic theoretical analysis of urban planning is presented, mainly including the introduction of the concept, nature and classification of urban planning. As the understanding of the basic concept and the nature of the object of study is a must for any theoretical research, on the basis of the definition of urban planning from the most authoritative legal documents, combining with the domestic theoretical research on urban planning at present, the author’s own understanding of the nature of urban planning is proposed.
