刑事侦查阶段中律师辩护工作的理性思考 ［主商要］侦查程序中的辩护在我国刑事辩护制度中一直是一个薄弱环节。长期以来，由于 “打击犯罪，维护稳定”的司法价值观在我国立法和司法中占有主导地位，使得我国刑事辩 护制度存在许多不尽如人意之处。律师辩护风险大、困难多、效果差。刑事辩护制度的完善 是一项系统工程，既涉及立法的进一步修改完善，乂涉及司法实践中对现有法律规定的正确 理解，还涉及人们对刑事辩护制度认识的进一步升肀。 ［关键词］侦查程序 律师辩护 调查取证权 Criminal Investigation stage of the work of rational thinking counsel [Abstract] The defense investigation process criminal defense system in our country has always been a weak link. Long time, because the fight against crime, maintenance of stability/1 the values of justice and judicial legislation in our country occupies a dominant position, making our criminal defense system has much to be desired.
