作为一种法律制度，前科报告在世界各国刑法上的历史都是源远流长，早在中 国奴隶社会的《尚书?舜典》，就有怙终贼刑的明确记载。1997年，我国刑法 第一百条明确规定：依法受过刑事处罚的人，在入伍、就业的时候，应当如实向 有关单位报告自己曾受过刑事处罚，不得隐瞒。理论界习惯称此条规定为前科 报告制度。该制度被看作是一种控制犯罪的社会间接手段，预防犯罪是其设立的 主要目的，这也正是其合理之处。2011年《刑法修正案（八）》第十九条免除了未 成年人前科报告义务，规定：。犯罪的时候不满十八周岁被判处五年有期徒刑以下 刑罚的人，免除前款规定的报告义务。理论界将此条称之为未成年人前科报告 义务免除制度，该制度是对多年以来未成年人轻罪犯罪记录封存制度试点经 验的确认，关键是修正和细化了现行刑法关于前科报告制度的规定。 d羊7T3 口 d羊 7T3 口 ,通过建立前科报告制度的配套制度、引入前科消灭制度来修补我国刑法关于 前科制度规定的缺陷＜ 关键词：前科前科报告犯罪记录制度前科消灭制度 Research on the System of Reporting Criminal Record Abstract As a legal system，the system of reporting criminal record has a long history in all the countries in the world . As early as in China’s slave society, it had already been definitely recorded in the “Shangshu ? Shun Dian”. In the China’s criminal law of 1997 , article one hundred stipulates clearly : people have been meted out criminal punishment according to law , when they enlisted or employed , they shall report the true information to the relevant units , shall not conceal . The system is regarded as a kind of crime control social indirect means to prevent crime is the main purpose of its establishment ,which is its reasonable .In 2011, “criminal law amendment (eight)”article 19 relieved from the minor criminal record reporting obligations . This theory calls“a minor criminal record report duty exemption system”，the system is on for many years“juvenile misdemeanor criminal record storage system”pilot experience , the key is correct and refine the existing criminal law about the provisions of the“criminal record reporting system” ? In this paper , the origin and the present situation , the concept of criminal record reporting system and advantages and disadvantages are analyzed , and then analyzed the criminal record of report system , which leads to the necessity of perfecting criminal record reporting system , finally , criminal record elimination system is introduced to perfect criminal legislation in our country .The thesis is divided into four parts .The first part i
