PAGE \* MERGEFORMAT PAGE \* MERGEFORMAT I 论我国优先承租权制度 摘要：随着房地产市场的繁荣发展，房屋租赁的情况越来越多，由房屋租赁所引发的矛盾也越来越严重。从法律层面来说，社会矛盾加剧必将引起法律问题，需要从法律规制的角度来解决。承租人是否具有优先承租权，以及这个权利如何行使是租赁关系中常见的问题，也是众多学者讨论的热点问题，本文就针对这个课题展开具体的研究分析。主要研究分析了优先承租权的定义，承租人要想行使优先承租权必须要满足合同期限已满、出租人希望继续出租、承租人满足“同等条件”等诸多要素。研究了优先承租权存在的现实意义，主要是为了市场经济秩序的稳定性，以及促进实质公平的实现。其次通过案例分析的方式，对实践中优先承租权行使中的各种问题进行了讨论。现实分析了如何对优先承租权做出定性，再是对权利行使中的“同等条件”和“时效问题”做出深入分析。 关键词：优先承租权 承租权 出租人 承租人 Abstract: Along with the prosperity and development of the real estate market, rental housing more and more contradictions caused by rental housing is more and more serious.
