山东科技大学硕士学位论文摘要 山东科技大学硕士学位论文 摘要 摘 要 环境侵权不同于一般的民事侵权，有其自身的特点，尤其是大规模的环境侵权日益 复杂化，特别是在影响的人数、涉及的范围以及影响时间的长度等方面较其他侵权行为 尤为严重。正是这些特殊属性导致了传统民事救济方式不足，使得很多环境污染受害者 得不到有效救济，因此传统的以个人责任为基础的救济方式已不能满足现代环境侵权需 求，应运而生的便是责任的社会化。环境侵权民事补偿基金作为民事责任社会化的方式 之一，是对传统民事侵权责任的一种补充。目前在国外与该种基金相关的组织或是制度 已经得到发展，我国在这方面还处于试点阶段。 环境侵权民事补偿基金的核心是通过政府财政拨款及社会捐助等多种方式筹集形成 资金，当特定污染源污染者不明确或是虽污染者确定，但环境侵权受害人通过一般民事 侵权诉讼最终得不到赔偿时，环境侵权受害人依据环境侵权民事补偿基金相关规定向其 申请从而获得补偿的一种救济方式。其目的在于有效救济环境侵权受害人。 本文综合运用了比较法、文献归纳法等方法，在分析现行环境侵权民事救济的局限 性基础上，引申出设立环境侵权民事补偿基金的必要性和可行性。接着对国外相关制度 规定进行介绍，为在我国环境侵权救济体系中引入这一制度提供借鉴。在明确了我国环 境补偿基金的性质、目的、设立原则、法律地位后，对基金的设立主体、机构设置、筹 资渠道、使用和监督等方面进行探索。 关键词：环境侵权 责任社会化 民事补偿基金 山东科技大学硕士学位论文AB 山东科技大学硕士学位论文 ABSTRACT ABSTRACT Environmental tort, which is different from the general civil tort, has the characteristics of its own, and especially large-scale environmental tort is becoming more complex, and its influence，scope and the length of time is incomparable. These special attributes lead to the traditional civil relief way is insufficient, which make a lot of environmental pollution victims get effective relief. So traditional remedies based on personal responsibility can not meet the modern needs of the environment tort, the responsibility socialization appeared. The Civil Compensation Fund of Environmental Tort is one of the civil liability socializations , which is a supplement of the traditional civil tort liability. Today, this type of fund have quite a lot of development abroad, but it is not yet built in China . The Civil Compensation Fund of Environmental Tort’s core is through the government financing and the social donation and so on to raise capital formation. when the victim of the environment infringement cannot be recompense by the ordinary civil relief, according to the environmental tort civil compensation fund related provisions the victim can apply for the fund compensation to get a relief way.
