摘要摘要 摘要 摘要 本文从中外环境保护法的发展及对相关责任体系的比较研究中，通过中外不同法系 园家环境侵权民事责任的不同架构原则的借鉴，力求为我国可持续发展的新形势下环境 保护和环境侵害责任追究探讨一条可操作性强、理论体系完整、归责原则明晰的环境民 事责任体系，对环境侵害、环境侵权民事责任、环境侵权民事责任制度架构等多方面做 了相应的探讨，强调环境侵害应从妨害行为、干扰侵害或近邻妨害角度认定，同时环境 侵害具有与 般民事侵权行为不同的特点，因此在处理环境侵权民事责任时，应当坚持 利益衡平原则、个体责任与社会责任结合原则和排除分割与损害赔偿并用的原则。在我 国环境民事责任的架构方面，从归责原则、构成要件、民事责任方式三方面加以阐释， 提出对环境污染损害赔偿应适用无过错责任，并应适当扩大无过错责任原则的适用范围 及明确规定免责事由。环境侵权民事责任构成要件上坚持“三要件”说，即违法性、损 害事实、因果关系，并做了细致的论证。 关键词环境侵权民事责任环境民事责任制度环境侵害 AbstractThe Abstract The development of this text therefrom outer environmental protection law reached tO the comparison research of correlation duty system，ties that the difference that the nation environment invaded the relating to civil law duty of power puts up constructing the reference of principle by way ofthe different laws of China and foreign countries，makes every effort to to go under the situation of development the environmental protection and the environment to encroach for OUr country the duty looks into inquires into the relating to civil law duty system of environment that the operation nature is strong and theory system is complete and principle is distinct，encroaches and the environment invades the relating to civil law duty of power and the environment to invade that the many—sides such as relating tO civil law system ofjob responsibility of the power degree flame constructs etc have done the corresponding inquirement to the environment，stresss the environment encroaches mad assents to nuisance and the interference is encroached or near neighbour harms the angle firmly believes，at the same time the environment encroaches on to possess with the generally relating to civil law tort different the characteristic．therefore deals wim environment when invading the relating to civil law duty of power，but should persist in interest weighing apparatus plain，individual duty and society duty combines principle and geeing rid of cuts apart and dos harm to compensates and the princit，le of usefulness．The relating to civil la
