1 1 Abstract It is the obvious deficiency of system being in Criminal Law of China that distinguish the differencies between suballeviative punishment and alleviative punishment only by the boundary and range of legal penalty. This has not only lead to empirical disputes which penalty of principle above the knob of legal penalty should actually how to be revised and regulated leniently,but also made the confussion arising from the theorial analyses within the punishment of suballeviation and alleviation. Consequently, there are several fundamental and important subjects must be faced when we expain and apply to norm about alleviative punishment which what is it , what for it, upon which to base,and however do it .Speakly in concrete terms, they need be so profoundly explored when it separately concerns idea of dimension,self-ontologenesis,categorial relations, and mechanical construction on alleviative punishment that we can promote and realize the operation of scientization, normalization, and rationalization to kinds of alleviative affairs.
