PAGE PAGE 10 CHAPTER ONE INTRODUCTION Reasons for Choosing This Study Legal translation as a product of human exchange and social progress makes possible learning, assimilation and transplantation of foreign law and legal systems. With the free movement of people and goods, legal translation becomes more and more important. Without legal translation, various legal culture communication and, especially, international trade could not be carried out. With the intensive cultural communication, legal translation has come into being. The literature on legal translation, however, is sparse. For this reason, both lawyers and linguists make an attempt to apply theories and strategies of general translation to legal translation, such as Yan Fu’s translation theory, Nida’s dynamic equivalence or functional equivalence, foreignization, metaphrase and free translation etc. They structure the guide line of legal translation from the angle of translation theory. As a matter of fact, legal translators or interpreters are still confused about which translation theories or strategies are suitable. People might as well combine the hermeneutics with legal translation. Frederick M. Rener (1989:57) pointed out that “translation is the procedure of hermeneutics rather than manipulation of language. He set up a relationship between hermeneutics and translation. Thus, there is intrinsic relation between hermeneutics and translation. Hermeneutics mainly studies the interpretation theory. In the west, hermeneutics theory used in translation studies begins in the 1970s. As a general rule of text interpretation, hermeneutic circle is extremely important in the process of text interpretation. It is taken the shape of paradox.
