1 1 论文摘要 HYPERLINK /finance/ 金融是 HYPERLINK /dangdai/ 现代 HYPERLINK /dangdai/ 经济的核心，关系国计民生的“命脉”，在国民经济建设中 日益发挥着巨大的作用。金融业又是经营货币的特殊行业,它对货币资金这 种稀缺性资源进行垄断性配置,包括发达国家在内的世界各国均对金融业 实行特别的经营许可证制度。这种权力的垄断加之社会资金特别是企业资 金的短缺，造成贷款难、融资难，这给金融系统公权私用带来了可乘之机， 为金融职务犯罪特别是贿赂型职务犯罪提供了天然的生长土壤。同时随着 经济体制改革的深入，金融系统其它类型的职务犯罪也十分猖獗，其犯罪 手段多样化、复杂化、隐蔽化愈来愈凸现，涉案金额十分巨大，给国家财 产造成了重大损失。金融系统职务犯罪已经成为影响社会稳定、危害金融 安全、破坏金融良性发展的重要因素之一。本文从金融职务犯罪概念引出 金融职务犯罪预防的概念并分析其特征。在 HYPERLINK /work/ 总结金融职务犯罪的主要特点 后，从主观、客观两方面对产生金融职务犯罪的原因进行了 HYPERLINK / 分析，继而从 构筑思想防线；强化内部、外部监督；加强制度建设、完善金融立法等方 面提出了金融职务犯罪的预防机制。 全文旨在通过通俗易懂的表述，使金融业内外工作人员对金融职务犯 罪有一个直观的、正确的了解，提高对金融系统预防职务犯罪工作重要性 的认识，为我国金融系统职务犯罪的预防工作献计献策。 关键词：金融职务犯罪 特点 原因 预防机制 1 1 Abstract finance is regarded as the central issue of the modern economy, which is the “life line” of the whole country and the civil people. And it plays an important role in the development of the national economy. Finance is a particular industrial sector which operating on the money in a monopoly way. So including the developed countries, all nations have established a special operation license system to this field. This kind of monopoly and the shortage of the social capital, especially in the companies contribute to the financing difficulties and loan difficulties, which opens a backdoor to the corruption of the public rights in finance system and provide a natural environment to the financial job-related crime, especially to bribe. Furthermore, with the development of the economic structure reform, other kinds of job-related crime on the finance system have become increasingly rampant. The criminal techniques have become more diverse, complicate and conceal. The illicit money is extremely large that causes heavy losses to the interests of the State. The job-related crime on the finance system has being one of the key factors, which brought the negative influences on the social stable, financial safe, and the financial sound development.
