首都经济贸易大学博 首都经济贸易大学博（硕）士学位论文 《论文题目》海上石油勘探开采环境污染法律责任研究 第 第 II 页 共 42 页 摘 要 改革开放以来，我国社会经济快速发展，能源开采方式逐渐多元化。海洋作为地 球生态系统的重要组成部分，在能源的利用和开采方面也占有着十分重要的地位。近 些年来，国际国内海上石油污染的事故频发，造成的危害巨大，海洋生态的环境保护 问题受到了社会各界的广泛关注。但由于我国海上石油勘探开采的责任承担还缺乏完 备的规定，因此，我国在处理此类事故时效果并不理想。 本文笔者在概括叙述了我国海上石油勘探开采环境污染的现状，对本文的研究背 景、研究的理论基础、研究方法及思路简要介绍的基础上，首先介绍了国内外海上石 油勘探开采环境污染侵权的现状。举出一些海上石油勘探开采环境污染的典型事例， 分析石油污染的危害性。其次对国内外海上石油勘探开采环境污染法律制度现状进行 介绍，进而以典型事例的比较为依托，对在中外法律体系进行比较，着重寻找与国外 先进国家成熟做法之间的差距，研究海上石油勘探开采法律责任的承担形式。 海上石油勘探开采环境污染的防治，必须要有一个与之相适应的法律体系。本文 的重点放在我国海上石油环境污染法律责任的承担分析上，主要从完善信息披露责 任、确定民事赔偿责任、行政责任的承担、刑事责任追究等方面进行了详细的研究和 论述。海上石油勘探开采环境污染问题的解决，关系到海洋能源的健康利用和社会经 济的繁荣发展，需要完备的法律体系作为依托，也只有这样才能有效防治污染。 关键词:海洋;石油勘探;污染;法律责任 第 第 PAGE III 页 共 42 页 Abstract Since the reform and opening up, Chinas rapid economic development, energy mining way gradually diversity. Marine ecological system as the earth is an important part of, in the use of energy and mining aspects also has a very important position. In recent years, the international and domestic offshore oil pollution accident frequency, the harm caused by the huge, Marine ecological environment protection is wide attention of all social sectors. But because Chinas offshore oil exploration and exploitation of the liability to the provisions of the lack of complete is, therefore, China in dealing with such accident effect is not good. In this paper the author briefly offshore oil exploration and exploitation in China environmental pollution situation, this paper the research background, research on the basic theory, research method and idea on the basis of brief introduction, first introduced the offshore oil exploration and exploitation at home and abroad and the present situation of the pollution of the environment infringement.
