I I 国有土地上房屋征收补偿决定强制执行的理论研究 中文摘要 国有土地上房屋征收补偿决定强制执行的理论研究 中文摘要 自古以来，土地及建筑其上的房屋，是民众最为重要的财产。土地 制度与民生问题息息相关。国务院 1991 制定、2001 年修正的《城市房屋 拆迁管理条例》施行阶段，随着经济社会的发展，因土地利益发生的冲 突日益凸显，在征地拆迁过程中的恶性极端事件时有发生。2011 年 1 月 21 日，《国有土地上房屋征收与补偿条例》公布施行，明确了司法强制执 行的原则。随后，最高人民法院出台了办理国有土地上房屋征收补偿决 定案件的司法解释，明确了以裁执分离为一般原则的执行模式。虽然新 条例和司法解释在一些方面取得了巨大的进步，但在制度上仍有可进一 步完善的空间。基于此，本文在对房屋征收补偿决定强制执行的概念、 特征及原则进行阐述的基础上，通过对执行申请、司法审查和强制执行 三个阶段的理论分析，提出明晰现有审查标准、建立强制执行实施权划 分标准、构建裁执分离模式下行政机关具体实施的程序以及完善违法实 施搬迁的法律约束机制等相关建议，以期更好地保障被征收人的合法权 益，防止在房屋征收补偿活动中恶性极端事件再次发生。 关键字：国有土地；房屋征收；强制执行；裁执分离；制度完善 作 者：赵 星 指导教师：王克稳 教授 II II Abstract The theoretical study of enforcement of levy compensation on State-owned land housing The theoretical study of enforcement of levy compensation on State-owned land housing Abstract Since ancient times, the land and building houses on it is the most important property of the people. Land system is closely related to livelihood issues. During the implementation period of “The Urban Housing Demolition Management Regulations, which was enacted in 1991 and revised in 2001 by State Council, the conflict of interest on the land has become increasingly prominent with the economic and social development. Vicious extreme events often occurred in the process of land acquisition and resettlement. On January 21, 2011, The ordinance of levy and compensation on State-owned land housing was in official promulgation, it clears the principle of judicial enforcement. Subsequently, the Supreme Court issued the judicial interpretation of levy compensation on housing, which clearly stated the principle of separation of sanction and execution. Although the new regulations and judicial interpretation has made great progress in some areas, there is room for further improvement in system. Based on the concept, characteristics, principles of enforcement of levy compensation on housing and the theoretical analysis on three stages of application, judicial review and enforcement, this article concludes the following suggesti
