贵州大学硕士研究生学位论文 贵州大学硕士研究生学位论文 PAGE PAGE 3 关于公民有效行使选举权的探讨 中文摘要：本文从法律的角度，对公民有效行使选举权进行研究既是契合现 代宪法学研究的，亦是契合我国社会主义法治建设的。对于政治的、经济的、文 化的保障作者暂不在本文中进行讨论；仅以法律保障的视野来探讨问题的成因， 给出合理、可行的解决方案。本文首先对选举权的性质学说、选举权的宪法地位 及法律结构进行了定位分析；解决了我国长期以来对选举权在宪法地位及法律结 构方面理论探究不够的问题。分析我国公民有效行使选举权存在的一些问题，从 而得出我国选举权救济制度的缺陷所在，设计出专门的选举监察组织和选举诉讼 程序。除此之外，在我国选举权有效行使的法律保障方面，建议不仅要严格遵循 现行的选举法律规定，还应通过立法进一步完善选举组织机构、选区划分和选民 登记、组织投票和确定当选等方面所显现出来的问题。对选举权的研究以期完善 我国的选举制度，在公正、平等的法律保障环境下最为有效的保障公民行使选举 权。 关键词： 公民 选举权 有效行使 选举制度 法律保障 Citizens about the effective exercise of the right to vote English Abstract: This article from the legal angle, exercises the voting right to the citizen to conduct the research is not only effectively the conjunction modern constitution study research, also agrees with our country socialism government by law construction.
