化、观念、思想方面的原因，大陆现有立法受计划经济时期国家利益 化、观念、思想方面的原因，大陆现有立法受计划经济时期国家利益 至上的影响，对个人利益的保护力度不够，受到一些学者的质疑。最 后是分析比较之后取长补短，完善大陆的拾得遗失物制度。一是增设 拾得人的实体权利，从道德以及经济学角度分析理论基础，认为应当 增设拾得人的报酬请求权、拾得人附条件取得所有权以及拾得人的留 置权，二是建立健全程序设置，将拾得遗失物送交部门多样化，遗失 物的招领程序统一化，并对小额遗失物处理方式区别化对待。 关键词：海峡两岸，拾得遗失物，报酬请求权 II AB AB STRACT Although both belong to civil law，there are many differences between mainland China and Taiwan about the system of Lost Property， SO we need comparative analysis． First，the connotation of the Lost Property system is different，the scholars of the mainland China and Taiwan have their own points of view about the concept and the elements of lost property system，to integrate， most scholars believe that the lostproperty is unoccupied and is a master of real estate， personalproperty， existed losts and unoccupied are the three constituent elements，namely，Mr．Wang Zejian adopted the three elements with Mr．Zheng Yubo said．Comparative analysis of the concept of Lost Property is also involved in the difference with the related concepts，namely，the concept of the mi splace and waif．Mi splace is a concept in criminal law，also is the object of crime of embezzlement，but criminal law in Taiwan setted special embezzlement of lost property．Considering theintent of legislators from the mainland，the concept of misplace is different from the common meanings，it refers to the renegade possession control led by the specific identity of the person， III mostly mostly in specific places，sometimes is based on the Finders’S specific duties．In addition，there are some special distinction lost property，including the separated animals and firearms， ammunition，and other laws prohibiting circulation of materials． The system of Lost Property is the combination of discovery and possession，between the finders and the owners correspond legal relations．The second part is focusing on the obligations and responsibi lities of people who picked up lost property，involved reporting and deposit obligations，custody obligation
