i i 摘 要 婚内侵权行为一直存在。在夫妻一体主义立法时期，这一问题并没有受到重视。 随着经济的发展，个人权利意识的觉醒，夫妻相互之间人格独立、地位平等的思想日 益深入人心，使得婚内维权的意识也开始萌发。因此，有必要对我国的婚内侵权损害 赔偿问题进行深入的探讨。笔者希望能够通过对婚内侵权损害赔偿制度的分析研究， 为完善我国相关立法提出建议，推动该法的完善。 针对上述问题，主要从以下四个方面分别进行论述： 第一方面结合侵权行为的概念和定义，从理论上对婚内侵权行为进行论述。 第二方面要从建立婚内侵权损害赔偿制度的必要性方面进行主要分析。针对建立 和完善婚内侵权损害赔偿制度的重要意义，分析我国婚内侵权损害赔偿的立法现状以 及不足之处。 第三部分对构建婚内损害赔偿制度的可行性进行具体分析和论证。通过对夫妻婚 内侵权损害赔偿制度进行比较法上的考察，从思想基础、法律基础方面为我国确立婚 内侵权责任奠定基础。 第四部分从立法方面对我国婚内侵权损害赔偿制度进行的构想。从建立健全配偶 权制度、完善夫妻财产制度、明确婚内侵权行为的范围、婚内侵权诉讼中非法证据的 排除及权利救济、婚内侵权诉讼中“盖然性”标准的采信等方面进行了论证。 关键词：婚内侵权 损害赔偿 法律规制 ii ii Abstract In the marriage the abuse of authority always exists.
