中文摘要电子邮件对互联网和全球经济的发展起到了不可估量的作用。可是，猖獗的 中文摘要 电子邮件对互联网和全球经济的发展起到了不可估量的作用。可是，猖獗的 垃圾邮件使得服务商和收件人受到了损害，垃圾邮件的发送者将成本转移给了互 联网服务提供商和收件人，并对信息经济、社会安全和交易秩序等诸多方面产生 了破坏作用。 由于因特网的自发性、边缘性、解构性等特征，因此改进技术、加强德化显 然不能解决问题。所以只有尽早对此立法，提高发送垃圾邮件的成本，给予受害 人足够的救济，才是消除垃圾邮件的根本方法。 本文通过对美国的三届国会(1999—2004)中的垃圾邮件立法案和29个州法 律的归纳，以及对7个相关的典型案例的分析，认为未受邀请、虚假陈述、欺骗 和滥用是垃圾邮件的本质特征。据此，本文提出界定垃圾邮件的法律标准，同时 根据普通法的侵权理论，推导出发送垃圾邮件的行为够成侵犯行为和造成实际损 失的法理。 在详细分析反垃圾邮件立法是否违宪的过程中(违反贸易条款和言论自由 权)，本文有意提醒我国，在立法时应该注意保护宪法赋予的权利。我国长期以 来是一个缺乏法治精神的国家，民众的权利意识也很弱。所以，一方面对于言论 自由权的滥用应该限制，另一方面不能因为这种权利被滥用从而反过来践踏这种 权利。通过分析，本文认为和在实体空间不同，由于网络的本质，不适当网络立 法的危害性会呈几何级数的形式被放大，所以对垃圾邮件的立法应该慎之又慎。 避免由于矫枉过正，而对信息经济和相关产业发展反起到阻碍的作用。在此基础 上本文提出了立法时应该遵循的尺度。 最后本文讨论了在我国现有法律框架下，除了明确法律责任外，如何根据垃 圾邮件的特殊性，设置有效的救济方法。因为垃圾邮件侵权案件具有即刻性、无 形性和难以统计性的特点，这使得事后的赔偿对于受害人来说，有时并不足以弥 补损失。因此，就像本文所述，只有设立相应的禁止令制度，和对每单一发送行 为规定可以请求的损害赔偿金额，才能切实地保护受害人并凸现出法律的公正。 关键词 垃圾邮件 违宪审查 言论自由 贸易条款 禁止令 AbstractE．．mail Abstract E．．mail has promoted the development of Internet and Global Economic．However, the spam make ISP and receiver insult，transfer the cost to ISP and receiver,impair information economic，society security,transaction order,etc． Because of the nature of Interact itself，such as spontaneity,this problem can’t be resolved just by technique and morality．So legislation is the essential way to eliminate the sparn through increasing the cost ofdistribution and granting substantial remedy． This thesis will analyze the spam legislation of United States，including Federal Bills(from 106n1 Congress to 108“)，State Laws(29 States totally)and 7 typical selected cases．Through the procedure of analyze above，we can conclude unsolicited， misrepresent，fraud and abuse arc the nature ofthe spam．This thesis proposes the law standard that how to distinguish the spam．Meanwhile，this thesis discloses the legal principle of the reason that sending spam is an infringing act and makes substantial damage． In the process of constitutional review on commerce clause and freedom of speech， this thesis reminds the legislative
