分类号学校代码 分类号 学校代码 10542 学号2Q!QQ!垒!Q壁曼里 看守所在押人员法律地位研究 On the Lega I Status of Deta i nees i n the Lockul fo r‘iiJ r I sonesone rr ss AwaAwa iI tt il ng T iI a II 湖南师范大学学位评定委员会办公室 二0一五年五月 万方数据 摘要看守所作为羁押依法被逮捕、刑事拘留的犯罪嫌疑人的场所，是 摘要 看守所作为羁押依法被逮捕、刑事拘留的犯罪嫌疑人的场所，是 法治和人权状况的敏感窗口，看守所大墙之内的状况，为世人瞩目。 近几年来，由于一些地方看守所执法不规范，不仅直接侵犯了看守所 在押人员合法权益，也给公安机关的形象带来不良影响。看守所在押 人员的法律地位，即看守所羁押的人员既作为国家的公民，又作为刑 事诉讼追诉对象的双重身份，在法律上所应当享有的权利和履行的义 务，其实质就是要保障在押人员的合法权益。在押人员的法律地位与 普通公民不完全一样，其所享有的权利及应尽的义务都要随之发生相 应的变化。当前我国看守所在押人员的法律地位及与之相配套的在押 人员的权利保障还存在着一些问题，明确在押人员的法律制定于二十 世纪九十年代，明显滞后于经济社会发展，公、检、法三家单位相互 配合、相互制约的诉讼体制不尽科学，看守所管理制度不规范，看守 所基础设施严重滞后、更新建设不足，取保候审、监视居住制度基本 被架空。我们有必要对看守所的性质、看守所在押人员的范围、看守 所在押人员法律地位的特殊性、看守所在押人员的权利及其被侵害状 况等方面进行系统分析研究，并在此基础上，提出完善建议，尽快制 定科学的《看守所法》，完善诉讼体制，增加财政投入，完善基础设 施建设，科学适用取保候审、监视居住等措施，以更好地保障在押人 员的权利。 关键词：看守所 在押人员 法律地位 万方数据 AbstractAs Abstract As detention in custody was arrested according to law,guilty of criminal detention places，is sensitive window rule of law and human fights situation，the situation within the walls of the detention center,have attracted worldwide attention．In recent years，some local law enforcement does not regulate the detention center,not only in direct violation of the legitimate rights and interests held in detention centers， but also to the image of an adverse effect on the public security organs． The legal status of persons held in detention centers，is the person in custody to the detention center,both as citizens of the country,and aS a dual identity of the Criminal Prosecution objects，fight on the law as it should be enjoyed and obligations，and its essence is to protect detainees legal rights．The legal status of detainees and ordinary citizens are not exactly the salne fighis and obligations which t11ey have enj oyed consequent change accordingly．We need the nature of the detention center,the range held in detention centers，the particularity of the legal status of persons held in detention centers，the fights of detainees and detention center conditions a
