I I 律师协会的行政法问题研究 中文提要 律师协会的行政法问题研究 中文提要 律师协会作为现阶段“两结合”律师管理制度中行使行业管理职能的行业组织， 在实际运作中存在着诸如角色定位模糊、职责权限不明、内部机制不健全等问题。面 对这些现实问题，笔者试从行政法角度探析律师协会在行政法上的地位和角色，认为 律师协会存在双重身份：即接受司法行政机关指导监督而成为行政相对人，对律师及 律师事务所进行行业管理而处于行政主体地位。律师协会的双重身份和扮演的两种角 色决定了其在实施行业管理的自治权时必然存在着局限性。为适应政府体制改革和律 师行业发展的需要，我们应当借鉴中外律师管理体制中的有效做法，建立适合中国律 师行业发展的律师协会自治模式。 关键词：律师协会 行政法 行业管理 自治权 作 者：王一敏 指导老师：章志远 教授 II II Abstract lawyers association studies in the perspective of administrative law lawyers association studies in the perspective of administrative law Abstract In the present stage of two combination lawyer management system, lawyers association as the industry organizations to exercise management function. However, in actual operation, there is always a lot of problems, such as the role, responsibilities unclear, the internal mechanism is not sound etc... In the face of these problems, the author tries to from the perspective of administrative law, analyses the status and role of lawyers associations in the administrative law, think that lawyers association has dual identity: on one side, it accepts the guidance and supervision of the judicial administrative organs, and become the administrative relative person; On the other side, industry management of lawyers and law firms, as the administrative subject position. The dual identity of Lawyers Association, decides that it has the limitation in the exercise of the industry management of self-government. In order to meet the development needs of the reform of government system and the legal profession, we should use the effective practice of lawyer management system in China and foreign countries, and to establish the bar association’s autonomous mode that can suitable for the development of Chinese lawyer industry.
