矿难的制度性分析-行政管理专业论文.docx

摘 摘 要 摘要 为找出矿难形成的原因和防范的措施，本文从公共管理、法律和行政监督、经济转型期 的矿难三个角度，用制度性分析的方法对此进行了一些探讨。认为矿难形成的公共管理方面 的原因是：传统公共管理方式在采矿业管理上存在不足、政府官员考核和激励机制扭曲、责 任机制不健全。这些缺陷表现为强势政府下的弱势治理、政绩考核只考核“显绩”、形成了 GDP偏好、采矿业管理中各方的责任不明确等。监督上存在的原因主要是我国尚处在“人治” 向“法治”的转换过程，法制环境不完善、立法和执法未能协调好等。正因为法律监督不完 善，对采矿业的监督仍然采用行政监督方法，但是行政监督已经不适应变化了的采矿业管理。 公共管理和监督制度的缺失和失灵在经济转型过程中以矿难的形式表现了出来，要有效应对 矿难就必须在采矿业管理上进行制度性创新，通过保证矿工的话语权、完善政府官员综合绩 效考核和激励机制、不断改善采矿业的公共管理体制来防范和减少矿难，制度创新可以使采 矿业管理步入制度化、规范化的轨道。在监督制度上，必须实行依法治矿，发挥法律监督的 稳定性、强制性、客观性等特点，使行政监督逐渐退出主导地位，并且在监督方式上要有所 创新，例如实行独立第三方监督、变“自上而下”为“由下至上”的监督新方式等。另外， 从危机的角度分析矿难，在矿难的管理上建立应急管理机制，使矿难防范、救援、处理也逐 步实现规范化、制度化。 【关键词】矿难；制度分析：公共管理；监督制度；制度创新 矿难的制度性分析Abstract 矿难的制度性分析 Abstract For The I nst i tut i ona I Ana I ys i S of M i no Ca I am i ty With the aim to find out the reasons caused mine calamity and preventive actions，the text applies the institutional analysis method to the discussion from the view of public management， law and administration supervisions，and economic transition．The reasons on public management that caused mille calamity am following：weak mine management through traditional public management method，the distortion of merit and encouragement system for officials，and the chaos of responsibility mechanism．All the above defects demonstrate the weak management under a strong government，only‘apparent achievements”checked by merit system,and cruse GDP partiality and responsibility ambiguicy of parties on mining management．hl addition，the reRSOUS on supervision are mainly that our country is in a transitional phase from“rule by men”to“rule by law’，SO that our legal environment is not perfect and legislation and law execution cannot wheel into line with each other．Due to the imperfect law supervision，the supervision on mining is still used through adminisuative method，which hash’t been adapted to the varying mine management． At last，the weakness and failure of public management and supervision system on mining management is shown in a form of mine calamity in the period of economica
