摘 摘 要 市场经济是风险经济、信用经济。在市场经济条件下，不仅信用的发生不可 避免，而且信用的存在也是市场经济运行的基本条件。为增强市场主体的信用， 避免信用危机，防范和减少交易风险，确保债权的清偿以及促进资金的融通，实 行市场经济的国家无不十分重视担保阀题，这就登然要建立和发展适应市场经济 要求的担保法律制度。担保物权制度的发展与经济要求有羞密不可分的关系。在 现代市场经济条件下，为适应企事业单位融资的需要和利于发挥财产的效益，出 现了新的物权担保方式——浮动抵押。浮动抵押的出现适应了现代工商企业的融 资需要，符合了时代发展的要求。我国《物权法》也与时俱进地引用了这一制度， 这对于促进我国经济的进步具有重要意义。 本论文以“论我国浮动抵押权的设定及实现为题，采用琵较研究方法和历 史研究方法探讨了我国浮动抵押制度的若干法律闷题。全文包括弓|言、正文和结 束语三大部分，其中正文由三章组成。第一章是全文的基础，介绍了浮动抵押的 起源、特性解析、各国立法例，从理论层面和法律价值角度分析浮动抵押的合理 性，并总结了浮动抵押制度的优劣势及其在我国的设立和意义。第二章结合国内 外相关理论与实践，详细考察了关于浮动抵押权效力的几个重要问题，并提出了 笔者对浮动抵押制度各项内容的基本观点。第三章在结合我国有关浮动抵押立法 与实践的基础上，着重论述了浮动抵押权的实现以及存在的润题，并对构建适合 我国国情的浮动抵押制度提出了自己的观点和建议。 关键词：浮动抵押设定实现 AbstractThe Abstract The market economy is the risk economy and credit economy．Under the marke￡ economy,the occurrence of the credit Can not only be avoided，but also is the fundamental condition of the function of the market economy．In order to build up the credit of the subject of the market economy,avoid the occurrence of the crisis of the credit，prevent and diminish the risk of the transaction,ensure the discharge of the creditor’S right and promote the circulation of the finance．all the countries that adopt the policy of the market economy lay emphasis on the problem of the guarantee，thus inevitably set up the system of the guarantee legal system that adjusts to the market economy．The development of the guaranty law has close relation with the elements of the economy．Under the condition of the system of氇e modern enterprise,in order to accommodate the need of the financing of the enterprise and bring into play of the efficiency of the property,it emerges a new kind of guarantee—floating charge．The emergence of the floating charge meets the needs of the modem industrial enterprise． answering for the need of the times．The real law introduces this systern．thus having a significant meaningfulness to the development of our country’s economy． This thesis’name is the setting up and realization of our country’S floating charge right．It discusses
