摘 摘 要 在法治条件下，司法的作用影响甚巨，而民事诉讼费用问题又关系 到司法制度的充分利用是否。这体现在诉讼费用是影响人们诉讼观念 的重要因素，诉讼费用是影响对弱者救济原则的重要因素，诉讼费用在 诉讼作为一种救济制度的运行中起着关键作用。诉讼费用这些作用的 存在及其功能的实现，使我们关注诉讼费用建设。 有关诉讼成本和诉讼效益的关系问题，近来已成为各国诉讼法学 者和实践部门重点考虑的问题。为解决民事诉讼的花钱费时，他们构 画和采用一系列的程序和制度降低诉讼费用，提高诉讼效率。但是这 些改革大多是在诉讼程序方面，很少涉及诉讼费用制度本身的问题，对 诉讼费用的制度的合理构建和探索，正是本文的切入点。 诉讼费用的相关理论，包括诉讼费用的含义和构成，裁判费的征收 合理化依据及裁判费的性质，诉讼费用的收费标准和负担，诉讼费用的 裁判和救济，诉讼费用的担保及诉讼费用的管理等问题。笔者从介绍 有关理论争论和各国实践出发，阐述了对这些问题的合理化解决方式。 在通过对诉讼费用作用的讨论和对诉讼费用制度作合理化构建后，我 们发现我国的民事诉讼收费制度存在诸多问题，必须全面进行改革和 完善，树立正确的诉讼收费观，制订专门的诉讼费用法，建设良性的诉 讼费用制度，以实现民事主体的程序基本权，符合民事诉讼的公正、效 率价值要求。 关键词：民事诉讼费用 救济制度合理性程序基本权 制度构建 AbstractJudicature Abstract Judicature plays 8 great role in a legal state．Costs of civil ligigation impact whether we have made full use of j udicial system，they influence people’S lawsuit idea and the principle of remedy of the weak．More— over，costs are the key of which ligigation practices systematically as a remedy mechanism．Given these，We have tO fellow with interest about the construction of costs system． The problem of 1awsuit cost and benefit has been a eentral issue in both theory field and practice department．To resolve high expense and time～consuming of civil action，they concept a series《proceclure and system tO CUt down cOStS and raise lawsuit efficiency．But these innova+ tion include more procedures than the system of costs itself。The afticle has just based on rational conception of the costs system． The related theories of COSTS include the concept and compostition of Costs，reasonable basis and nature of adjudicative fee，collecting standard and burden of COSTS，judgment and remedy of costs，seeurity and man。 agement of COSTS。The author introduces concerned theory issue and practice in other countries，elucidates the method to resolve these prob。 lems。Through the discussion about their effect and construction of their system，he points out a series of proplems in our civii costs system，and suggests that we should enact special law about costs，establish right idea of costs collec
