摘要摘要 摘要 摘要 传统的对于精神损害赔偿的观点主要是适用于侵权领域，各个国家都有比 较成熟的法律规定，我国对于精神损害赔偿的法律规定也在不断地完善之中。 但是，当侵权所造成的精神损害赔偿成熟之际，随着社会的不断发展，精神消 费的不断增多，合同当事人的违约因为合同标的的不同，合同性质的变化，造 成的精神损害也呈上升趋势。这时，违约的精神损害赔偿更加凸显其重要性。 世界各国不论是理论还是实践对于违约的精神损害赔偿的确认都更加类型化、 科学化。有鉴于此，本文通过对违约损害赔偿、精神损害赔偿以及各国立法例 的比较分析来探讨违约的精神损害赔偿的必要性。 本文由前言、正文和结论组成，正文分为五个部分，第一部分从违约的损 害赔偿和精神损害两个方面探讨违约的精神损害赔偿。第二部分从理论角度分 析违约的精神损害赔偿存在的必要性。第三部分对学界中对违约的精神损害赔 偿的不同看法做以反驳。第四部分通过各国立法对违约的精神损害赔偿的规定 进一步探讨违约损害赔偿的必要可行性，并且对我国的立法进行研究提出建议。 第五部分对我国违约的精神损害赔偿制度的构建加以阐述，对于违约的精神损 害赔偿做以限制。 关键词：违约、损害赔偿、精神损害赔偿、违约的精神损害赔偿 AbstractAbstract Abstract Abstract The traditional view for mental damages are mainly applicable to tort，each country has a relatively mature law,0111country’S law of damages is continually being improved．When the infringernent damages caused by the spirit of the occasion of mature，with the continuous development of socity,the spirit of the growing consumption，parties to the contract because the contract subject to different default，the changing nature of the contract，mental damage caused also on the rise．At this time，the spirit of breach of contract damages highlights its importance．Countries in the world both in theory and practice of damages for breach of the spirit are moro types of recognition and scientific．In view of this，the paper for breach of contract damages for mental damages and comparative analysis of national legislation to investigate cases of breach of contract damages the spirit of the need． This article is from of the introduction，body and conclusions of the composition．Text is divided into five parts．The first part of the damages discuse the breach of contract from both of the breach of contract and mental damage．The second part is from the theoretical point of view to intrduct he spirit breach of contract damages for existence．The third part counter the different views of the academicspirit in damages for breach of contract．The fourth part，through the spirit of national legislation for damages for breach of contract provisions
