论文摘要票据丧失是票据流转中的异常情况，而且票据丧失还经常与票据伪造 论文摘要 票据丧失是票据流转中的异常情况，而且票据丧失还经常与票据伪造 相联系。本文从票据丧失的概念入手，通过比较的方法，分析了我国票据 法律制度在票据伪造方面的价值取向，为不同的丧失票据占有者，尤其是 丧失票据直接占有的非票据权利人设计了一整套的补救方法，填补了国内 票据法研究中在非票据权利人丧失票据后缺乏对非票据权利人的补救方法 研究的理论空白。本论文共分四个部分。 第一部分：从票据丧失的基本概念入手，对几个重要概念进行了重新 界定及澄清。 第二部分：通过对日内瓦法系、英美法系以及我国票据法律制度的比 较分析，探讨我国票据法律制度在票据伪造方面的价值取向，以及失票人 转嫁风险的可行性。这一部分是本文的重要理论基础。 第三部分：运用基础理论探讨我国票据法所规定的对票据权利人丧失 票据的三种救济方法的具体适用及相应的法律原理。 第四部分：运用票据基础理论以及票据伪造、风险转嫁的有关原理， 针对不同的票据丧失情形，对丧失票据直接占有的各类非票据权利人设计 补救方法。这一部分是本文的重点，是笔者的重要创新。 关键词：票据丧失补救 AbstractForfeiture Abstract Forfeiture of bills iS an unusual situation in the circulating of bills．What’S more，forfeiture of bills is often associated with forgery of bills．This dissertation，which begin from the concept of forfeiture of bills，with the method of comparison，analyzed the orientation of values about forgery of bills in china’S legal system about bills，and devised a set of remedial methods for those who have lost their bills，especially for those non obligee of bills，who have lost the bill．It fills the gaps of theory of the means of relieving those non obligee of bills，in the studies of laws governing bills．This dissertation is divided into four parts． Part One：With the concept of forfeit of bills as a start, redefines and cleared up several important concepts． Part Two：Through the comparison of the legal systems of bills in Geneva genealogy of law，Anglo．American genealogy of law and the laws of china，it discusses the orientation of values about forgery of bills in china’S legal system system governing bills，and the possibility of the forfeiter transferring risks．This part is the basis of theory of the whole dissertation． Part Three：Applying the basic theory,discuss the three methods of remedy for those obligee of bills，who forfeit the bills，stipulated in china’S laws governing bills，their application and the corresponding principles of laws． Part Four：Applying the basic theories about bills，and principles about forgery of bills and the transfer risks，devise
