摘要本文以海上保险代位求偿权这一保险理论中的热点问题作为研究对象。 摘要 本文以海上保险代位求偿权这一保险理论中的热点问题作为研究对象。 代位权有狭义与广义之分，狭义的代位权仅指代位求偿权(权利上的代位)， 广义的代位权不仅包括权利上的代位还包括物上代位权。本文作者从狭义的角度 出发，以民法和保险法的理论为基础，第一章分别对海上保险代位求偿权的概念、 理论基础、功能、性质及其独特性作了详尽的论述。代位求偿权源于民法上的债 权让与制度，性质上属于法定的债权让与，与不真正连带债务理论有较相似之处。 代位求偿权是保险合同补偿性，维护保险人利益为目的，是法律公平的体现。但 与民法上的代位有明显的本质上的区别。海上保险中的代位求偿权还具有其海上 活动中存在着航行过失免责制度及赔偿责任限制这一独特性。 第二章在剖析海上保险代位求偿权概念及性质的基础上，笔者详细地分析了 海上保险代位求偿权的成立条件、行使条件、行使方式以及海上保险代位求偿权 的效力等问题。在本章中，笔者主张代位求偿权的成立应以保险合同的有效成立 为首要条件。从五方面论述其行使应具备的条件，并在代位求偿的行使名义问题 上，笔者始终坚持保险入应以自己的名义行使或通过申请变更为自己的名义行使 其权利。即严格按照《海事诉讼特别程序法》的规定行使，维护了保险人的利益。 第三章初步探讨了海上保险代位求偿权所涉及的诉讼问题：诉讼主体、诉讼 标的、诉讼时效三方面的问题。在诉讼时效问题上，笔者主张比照我国《海商法》 第257条加强对保险人代位求偿权的保护。本人试图对海上保险代位求偿权做一 个比较系统全面地论述，希望对从事保险业务的有关人员有所帮助，能起到一个 抛砖引玉之效。 关键词：代位求偿权，海上保险代位求偿权，海上保险，海商法，海上保险法 ABSTRACTThe ABSTRACT The thesis takes the right of subrogation，a hot tropic in theory in marine insurance as its research object． The subrogation has narrow and the branch of the broad sense．and that the subrogation of narrow sense only indicates subrogating begging repays power(in the right subrogation)，and subrogating on the subrogation of broad sense not only includes the right still includes thing previous generation’s power．Theory with civil law and insurance law is the foundation to the angle depart from narrow sense of this text authoE and that the genemlly thought of power,theory foundation，merit ability and quality unique nature has done discussing of detailed to the marine insurance is subrogated respectively to beg to repay that in chapter one and chapter two．The subrogation originated from the subrogation system and compensatbn of contmd of insurance and can be classified to the statutory right of subrogation in civil law．Being one of the statutory subrogation。it is quite smile to the theory of non-genuinely joint and several liabilities．The subrogation in marine insurance has its peculiarity, that is．there exist exoneration from the liability in the navigation or management of the ship and limitation of for marine c
