蔓望垫 蔓望垫 一一 !苎堡垦 论集会权 中文提要 本文的目的是通过对集会的原理的分析和各国集会法的比较研究，来澄清人们对 集会自由的片面认识，并对我国《集会游行示威法》的修改提出着干建议。 集会权不仅是人身自由权与言论自由权的延伸，而且是公民相互联合采取集体行 动的权利。集会也是人民行使民主权利的重要方式。集会权是公民社会健康成长所必 彳i可少的。集会自由可以促进人民知识的增长和道德进步，提高人民的民丰素质。集 会自由也有一定的限制，但对集会的限制必须尽量少而明确。国家机构应为合法集会 提供物质保障、安全保障以及对参加集会者个人权利的保护。我国《集会游行示威法》 应当在立法的指导思想上作出转变，著对集会的申请程序、时间地点限制、集会的主 体限制、法律责任等方面进行修改，以充分保障公民的集会权。 关键词：集会权民主 公民社会保障 作 者：张祖明 指导老师：周永坤(教授) 旦!』土I_————一 旦!』土I_————一———————————————l——————_*————-————-—___-—’———————————__—————————_h-———_-——_———，————————d—-———— 苎兰堡些r ’ On the Rights ofAssembly Abstract The purpose of this dissertation is to make people have a comprehensive recognization of the liberty of assembly through the discussion on the principle of assembly,and to give some advice on the amends of our country’s Law oyAssemb以 Procession,and Demonstration through the comparative analysis of other country’s law of assembly The rights of assembly is not only the extension of liberty of person and freedom of speech，but also the rights of people to unite and act as a group It is also all important style for citizen to perform their democracy fights It is absolutely necessary fof the wel】development of civil society improvement of socia common morals，the improvement of citizen’s democracy quality The rights of assembly should be given some limitations in order to assure public safety and other people’s equally important liberty,but these limitations must be as few as possible and be clear-cut。The state organization should provide material assurance，body protection，and procedurM protection for people’s assembly． We should have our country’s Law ofAssembm Procession,and Demonstration transformed on the directive principle of legislation．Also it should be amended at such aspects as the procedural to apply assembly,the limitation of speech，the limitation of sites，the responsibility of breaking law of assembly,etc．this dissertation give some advice on the
