摘要摘 摘要 摘 要 现实社会生活中，随着人们社会经济活动的同益频繁，各种偶然因素引发 的危险常常对人们的人身和财产安全构成威胁。 最高人民法院于2003年12月4同通过了《关于审理人身损害赔偿案件适 用法律若干问题的解释》，其中的第6条对安全保障义务作出了规定，使得相关 安全保障义务的案件审理有了判案依据。2009年12月26日《侵权责任法》第 三十七条又从法律上对安全保障义务做出了明确的规定。本文运用实证分析和 比较分析的方法，对安全保障义务作了较为系统的研究，以期对我国安全保障 义务制度的完善有所帮助。 本文共分五章。第一章对安全保障义务的理论来源作了相关探究，同时解 释了安全保障义务的概念和性质，并从经济学理论和社会学理论两个方面对安 全保障义务的法理基础进行了分析；第二章对安全保障义务的主体进行了探讨， 阐述了安全保障义务的来源，并把安全保障义务的主体化为义务主体和权力主 体两个层面；第三章论述了安全保障义务的内容和判断标准；第四章介绍了安 全保障义务的责任形式，重点介绍了补充责任的特点；第五章对我国安全保障 义务的现状进行了阐述，并对我国侵权法上的安全保障义务制度的完善进行了 思考。 关键词： 安全保障义务一般安全注意义务补充责任过错推定 economy economy development，our human and belong safety are often threatened by the dangerous coursed from various indetermination reasons．Aiming at the increasing accidents occurring in prosecution places such觞rumpus rooms，marketplaces，hotels， restaurants and SO 011 in judicial practice，the Supreme People’S Court passed the 111e explanation to some law applicability problems about the cognizance person damage compensation caseson December 4m 2003．And theThe Tort Law of the People’S Republic of Chinawas adopted at the 1 2th session of the Standing Committee of the Eleventh National People’S Congress on December 26，2009．The Article 37 of the Tort Law made a positive stipulate on Duty of Safeguard for Security．The author uses the comparative and positive method to discuss the theoretical foundation of laws，the contents，the concept，the nature，the form of liability of the caSe about the obligation of security and the act violating the obligation of the security and hopes it will be helpful for the perfection of the system of the obligation of secufity The dissertation comprises five parts． Chapter One is summarization．Firstly introduces the definition and character of the duty of safeguard for security’and then introduces the theory origin of the duty of safeguard for security；Chapter Two discusses the doctrina gist of the duty of safeguard for security Chapter Three discusses the content and the judging criteria of tlle duty of safeguard f
