论公共权力的制约摘要 论公共权力的制约 摘要 (腐败1j公共权力制约是矛盾刈莎的两个方面。任当代社会，腐败与 {f：会生活的各个领域保持着紧密的联系，成为社会普遍关注的焦点问 题。在巾围共产党的领导卜-，新中闰的反腐倡廉』：作取得了巨大的成就。 但同时，埘于新旧体制交替的发展过程中出现在一定范围内的腐败现 象，人们不能掉以轻心，并且应当清醒地认识到腐败问题继续蔓延和不 断恶化的可能性。 反腐败是任何合法政权必然高度重视的重要工作，反腐败的根本途 径则为标本兼治、正本清源，将腐败的治理纳入法制的轨道。反腐败的 关键在于全面加强公共权力的监督与制约，将公共权力的行使严格限制 在应然的范围，以有效地实现保障公共权力廉洁清正的历史使命义 本文以公共权力制约的法律机制为基本线索，对当代中国的腐败问 题进行多角度的研究分析。首先，文章力图对腐败的基本概念加以明确 的界定，在所确定的定义的范周内对腐败的特征与腐败对社会造成的重 大损害进行深入的分析。其次，文章将当代中国的腐败问题纳入特定的 历史条件，从公共权力与社会物质生活条件的相互关系上，对产生腐败 的社会原冈、制度原冈与文化原因进行深入的研究与探讨，希望在此基 础上为反腐败的制度设计提供理论依据。再者，文章在整理与分析国际 反腐败成功策略的基础上，就当前国内的反腐败体制与基本方法进行分 析，肯定其中的成功，揭示其中的缺陷，为有效的制度设计提供现实的 基础。最后，文章结合中国的基本国情，在借鉴和总结国内外反腐败经 验的基础上，依据“权力法治”的原则，针对公共权力的制约与腐败的 防治，提出了最优化制度设计的基本构想。 关键词：腐败、公共权力、制约机制、廉政建设． About About the constraint on Public Power Abstract Corruption and constraint public power are opposites in a contradiction Nowadays， corruption keeps a close relationship with every aspect ofsocial life，which has become the focus of universal concem．Under the leadership of the CPC，great accomplishments have been achieved in new China S Anti-corruption”campaign．Nevertheless，instead of lowering our guard against the corruption occurring in certain fields during the procedure in which the old system is being replaced by the new one，we are supposed to awaken ourselves clearly to the possibilities ofthe further deterioration and extension ofthis problem． Any legal political power will have to attach much importance to“Anti—Corruption”，the essential way of which is to take thorough—going measures by looking into both the symptoms and roots and put“Anti—Corruption’on the legal course The heart of the matter iS to fully strengthen the supervision and constrain on public power and strictly confine its execution within proper range，SO as to effectively fulfill the historic task of protecting public power against corruption The paper makes a multi—angle analysis of corruption in modem China taking lawful constraint mechanism on public power as the main thread of thought．Firstl
