论宪法权威——以稳定性为视角 论宪法权威 ——以稳定性为视角 宪法与行政法学专业 研究生翟彦指导教师陈驰 摘要：本文以稳定性为视角，对宪政理论中的基础性问题——宪法权威 进行了研究和论述。首先通过“权威”的概念对宪法权威的定义作出了明确界 定，并将宪法权威的特征分为形式特征和实质特征进行分析，提出宪法权威的 构成要件。接着，通过对宪法权威的定义的剖析，引出宪法权威与宪法稳定性 之间的关系，并从市场经济、民主政治、宪法观念、宪法规范和社会环境等方 面的稳定性对宪法权威的影响进行了论述。这为最后结合中国宪法实施的实际 情况和问题，提出以稳定为视角实现宪法权威的对策。 在本文的论述过程中，运用了中西方宪法发展的比较、大陆法系和英美法 系在实现宪法权威方式上的比较，多角度阐明了宪法稳定性与宪法权威的关系， 并通过稳定性的视角广泛深入讨论了宪法权威的实现问题，并综合运用法理学 的思维方法对在转型时期中国宪法权威的实现进行理论探讨与总结。 关键词：权威宪法权威稳定性 Abstract：In Abstract：In thi S paper，the author has a research and di scussion about the constitutional authority，which iS the basiS issue of constitutional theory from the “stability”perspective．Firstly，the author made a clear definition about the．constitutional authority through the concept of authori ty，and then she made an analysi s about the constitution’S form characteristic and substance characteristic according to the characteristics of constitutional authority and put forward the elements of constitutional authority．Then，the author led to the relationship between the constitutional authority and the constitutional stability according to the definition anatomy of the constitutional authority，the author alSO has discussed the stability impact of market economy，democracy，constitutional concepts，the constitutional norms and SOCial environment on constitutional authority． This presents a countermeasure for realizing the constitutional authority from the stabi 1 ity perspective according to the actual situation and problems in China． In the process of discussion，the author explains the relationship between constitution stability and constitution authority from many perspectives which using the comparison of the constitutional developments in the West and East，the Continental Legal System and the Anglo—American law system，and then through the view of stability，she has a extensive diSCUSSion about the realization of constitutional authority， and then she integrates the use of jurisprudence way of thinking and makes a theoretical discussi
