提要本文通过政府角色理论、新公共行政理论、行政法学范式转换理论来探讨海 提要 本文通过政府角色理论、新公共行政理论、行政法学范式转换理论来探讨海 关与行政相对方相互关系的重新定位。 文章首先分析了目前海关与行政相对方相互关系不合理定位所造成的危害， 以及产生这种状况的原因，包括历史的、文化的、现实的多种因素，其中有些是 官僚行政所共有的，有些则是中国或是新中国所特有的，包括传统的和体制的多 方面因素。 文章得出一些有意义的结论：海关要与行政相对方建立平等的、服务与被服 务的、合作伙伴式的关系。笔者用了一定篇幅来介绍国外海关目前一些值得我们 借鉴的好的作法和理念来作为这种结论的佐证，更多的则是通过一些公共行政理 论来验证这一结论的合理性。最后，提出了一些具有建设性的建议作为海关与其 行政相对方建立这种关系的要件。 关键词：公共行政：行政法学；海关；行政相对方 C93-03 AbstractThis Abstract This article discusses the repositioning of relations between the customs and the private party in the adminis岔afive process through the role of the govemmenL the new theory of public administration and the paradigm shift of administrative jurisprudence． Fist．the article analyses the harms as a result of in appropriate relations at present between customs and the private party of administrative process，and the root causes underlying，including historical，cultural factors and the realities，some of which are删te common in bureaucratic administration worldwide while some others are unique in China,including traditional and institutional factors etc． The article has come to some significant conclusions followed：the castoms should establish the partnership wim the埘vale party of admimstratNe process on all equal footing鹊the service provider and the client．The author has gone to great lengths to inlroduce some best practice and concepts in other countries to support his conclusions．What’S more,the author has offered a series of public administrative theories to verify the validity of his conclusions。In the end．some suggestions have been proposed as the essential factors for this relation between the customs and the private party in the administrative process． Key Words： public administration，administrative jurisprudence，the customs，the private party in the administrative process C93—03 2 引 引 言 这篇文章要谈论的问题在中国司空见惯，我们很清楚，千百年来，在我们这 个国度里，人民对政府的行为大多持怎样的态度。今天重新拾起这个问题，那就 是政府官员如何去面对百姓的问题，更加深刻一些就是国家与社会的关系、政府 与公民的关系，权力与权利的关系，行政主体与行政相对方的关系。 建国以来，行政机构多次进行改革，然而始终走不出“精简——膨胀——再 精简——再膨胀
