浅论离婚案件中妇女财产权益的保护 摘要 近年来，虽然法律和制度对于保护妇女婚姻家庭权益作出了很多有益的规定，但由于诸多的社会历史因素的共同作用，社会对女性歧视的观念仍根深蒂固，女性自身思想和经济上的独立性欠缺，法律上的维权意识仍弱，从而导致了她们对男性和家庭的过分依赖，在家庭和社会上的地位较低。从而在离婚诉讼当中暴露出一些问题，反映了法律保障措施与现实权利实现之间仍存在差距。主要问题在于对于配偶与她人同居问题举证难，女性索赔无保障；对于家庭暴力的无声忍受导致离婚时利益受损；以及共同财产和房屋的分割问题反映出女性在经济上的困境和法律意识的淡薄。产生这些问题的原因有制度和法律的操作性问题，但更重要的是女性自身意识和经济上的独立性欠缺，从而导致其家庭和社会地位处于劣势。因此，要达到标本兼治的目的，必须从内因和外因两方面加以完善。首先从要改变妇女自我边缘化的意识，树立独立自主的思想，这就要加强宣传教育，促使妇女不断学习。其次要在客观方面加强法律、劳动制度和社会保障制度对女性权益的保障，从外在环境上真正实现两性平等。 关键词：离婚案件 妇女 财产权益 保护 On The Protection of Women’s Property Rights In Divorce Cases Abstract In recent years, although the law and system of protection of womens marriage and family rights have made a lot of useful, but because of many social and historical factors, the concept of social discrimination against women is still deeply rooted in womens own ideas and economic independence, the legal rights awareness is still weak, which led to their over reliance on men and families, in the family and social status. In order to expose some problems in the divorce proceedings, it reflects the gap between the legal safeguard measures and the realization of the real right.
