II II Abstract An abettor is a person who purposely causes others’ criminal intent. Abettors, organizing offenders and accessory offenders are accomplices who haven’t committed a crime directly in a complicated joint crime, that is to say, they don’t implement any specific offenses. Difference between attempted crime of an abettor and attempted crime of a single criminal is obvious, and it also differs from attempted crime of executor in a joint crime. So it’s a very special and complicated situation. Attempted crime of an abettor is one of the most complex problems in theory of joint crime, and it’s always highly argumentative. Theoretically, the basic reason of different voices is coming from different standpoints causing by different understanding to attempted crime of an abettor. With regard to the doctrine about the nature of abettors, the main points are mainly from three aspects: the theory of subordinateness of accomplices, the theory of independence of accomplices and the theory of duality of accomplices. Different standpoints of theories directly results in the different views to the definition and the scope of attempted crime of abettors. Combination of the different understanding of Chinas Criminal Code Article 29, paragraph 2, the theory agree with the basis from the theory of subordinateness of accomplices, conception is the attempted abettors have based on the abetting to carry out criminal activities but have not completed. The scope of uncompleted pattern of abettors is only limited in the situation described in Article 29, paragraph 1. An abettor is not only involved in the abettor theory, but also involved in attempted crime theory. It is cross and integration of these two theories The identification to the uncompleted pattern of abettors should be from the start, not succeed and causes beyond volition .This is to hold discussions on three areas.
