Based on the statistics, China has 185 million old people, which accounting for about 13.7 percent of the total population. It is predicted that Chinas aging population will up to 448 million in the end of 21st century, which accounting for one-third of the population. The number of the old is very large, and lots of those are disabled or semi-disabled. There are many other characteristics of it , such as older age, little children, empty nest. Therefore, it is very essential to pay attention to the elderly support problem, particularly the elderly spiritual support. Introduce “Go home often into the protection of old peoples rights, it reflects the legislative affirmation and support for the elderly spiritual support. The protection of old peoples rights” were revised in 2013. Only have some principled regulations about the elderly spiritual support were include newly, like the rights and obligations party and legal responsibility, etc were not made clear in the law.In judicial practice, the elderly spiritual support rights does not get effective guarantee, go home often is always faced with the embarrassment of walking on the road. China has already entered an aging society, the trend of population aging have been gradually deepening, the support issues of old people is not just affects the family harmony, but also impact the social instability. The research of the elderly spiritual support problem will become meaningful. Therefore, this article get lessons from the relevant rules in ancient time and abroad, based on the reality of China, perfect the legal regulation of the elderly spiritual support in some superficial research.
